My disdain for the particular form of government that is American democracy has been well documented, so it very well may be that the wisdom I herein intend to divulge will fall on ears utterly disinterested in the wisdom I intend to divulge. However, it has slowly become clear that the idea of impeachment, long espoused by those feeling particularly maligned by the government in power, is not in this case the idle wishfulness of the political minority, but a real possibility that stands to do lasting damage to the United States. As such, I feel duty bound to warn against such a course of action, in an attempt to save the peoples of America from the conflict and fear that I was once born alongside. As I have described in my past works, …show more content…
Firstly, the idea that Trump ought to be impeached for violate any assortment of felonies committed as a civilian is faulty, as it is in violation of the very Laws of Nature I have set out in the past: that in the interest of peace, past offenses no longer in practice ought to be forgiven, and that punishments ought only be applied to correct the offender and to protect the contract, and for no reason other (7). Secondly, the argument that Trump ought to be impeached for any misdeeds done in office is dangerous, as it would be damaging to the social contract to try and subject the sovereign to any authority but his own (8). Thirdly, the argument that, in allegedly enlisting help from Russian is winning the 2016 election, Trump violated the social contract himself, is absurd. The election of a candidate is not a contract between him and the people, but rather a contract between the people themselves in regards to who is fit to rule (9). As such, Trump himself cannot be removed from office for violating the contract he himself had no part in making. Lastly, the argument that any of the above should be used simply as a pretext to remove an abusive or poor leader from power is also flawed in that, seeing as every U.S citizen is an author of this contract, the responsibility of Trump’s performance lies solely with them, and
As a result, the Democratic-Republicans began to distrust the judiciary even more. Jefferson felt that impeachment was the sole way to make the courts respond to the public. Congress eventually impeached and removed a district judge, John Pickering. The House of Representatives also voted to impeach Justice Samuel Chase, but the Senate voted in Chase’s favor. This decision was historic because it guaranteed the independence of the judiciary branch and therefore strengthened it.
Most Americans view the Constitution as a sacred document that created the world’s greatest democracy but, in actuality, the American Constitution has many highly undemocratic aspects that prove this judgement to be mistaken. This is brought to light in Dahl’s analysis of the American Constitution.
Although Trump is currently getting investigated for Russian collusion and obstruction of justice, there is still no direct evidence tying Trump to the Russian conspiracy. President Trump has not been charged for these accusations yet, and he has not used executive privilege as a legal defense. While there is a lot of uncertainty
In Jeffrey Tulis’ “Impeachment in the Constitutional Order”, he argues that it is necessary
All things considered, Mark Sutherland has brought together a provocative corps of respected scholars and legal thinkers who collectively offer an incisive critique of a judiciary gone awry while they offer constructive solutions for reform. They make it abundantly clear that we the American people do not have to be slaves to the edicts of these black-robed deities. Their adroit assessment of the federal judiciary is intelligent, rooted in a principled esteem for the rule of law and constitutional popular rule, and their solutions are constitutional defensible, practical and tenable. One thing is resoundingly clear, we must stand up to these demigods in block robes that contravene the design of our federal republic and offer outlandish decisions at odds with the will of the vast majority of the people. It is paramount that the American people awaken and voice their discontent to their elected representatives in Congress if we are to abate judicial tyranny.
Catt explains the history of America’s democracy, political stand and goals through events and quotations of certain presidents. She states, “Abraham Lincoln welded those two axioms into a new one: ‘Ours is a government of the people, by the people, and for the people.’” , she states another quote, “Fifty years more passed and the president of the United States, Woodrow Wilson, in a mighty crisis of the nation,
This sets the stage for the checks and balances from the judicial and legislative branches of government that must be, and have been, done at times in order to reign in the power of the presidency. The successes, not only in the subsequent leadership, growth, and ability of the executive office, but the successful checks and balances in the 20th century, such as Watergate, U.S. v Nixon, and others, are thanks to the founder’s framing of the way our government operates. Strong leadership, while having a guaranteed opportunity to change a government that may have become too powerful, is an inherently American ideal, and is what the founders intended for the future of our
Therefore, part of Trump’s platform must be the Constitution. In the 10th Amendment of the Constitution, it is written, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the states respectively, or to the people.”. This means the same thing that Article 2 of the A.O.C does. All powers that are not expressly delegated to the central government, are the responsibility of the states. Donald Trump is also a known supporter of
In the U.S Constitution, it states that if President is convicted of any treason, corruption, or any other high Crimes and transgressions they can be removed from office. However, there are many steps to being impeach. The first thing in order for the President to be impeach is when the situation of the President brings attention to the members of the House of Representatives. Next, they are handed over to the House Judiciary Committee to see if the situation is serious. If the situation is serious then the president would be presented to the U.S Senate to decide if he should be impeached.
Problems in America only grew worse when democracy was being added to the mixture of already complicated politics. In Woody Holton’s book, Unruly American and the Origins of the Constitution, he stated that, “many Americans. . . were growing ‘tired of an excess of democracy,’ a ‘prevailing rage of excessive democracy. . .’ [or] ‘democratical tyranny.’” Democracy was an attempt at home rule among the colonies, but not everyone was happy with this extreme excess of colonial citizens contribution to the government.
During his campaign he used manipulation to become president. His claims differed drastically from the actions he is taking now as President. Ethos or authority is not a credible source just because you are president and claim you will build a wall, get rid of obamacare,
The Constitution fastens the responsibility of trying impeachments upon the Senate. Yet some Senators have doubted whether they have the requisite competence to try impeachments . Rule XI was adopted as a response to poor attendance and preparation by Senators in impeachment trials in the early twentieth century. Yet even in the 1980s, some Senators claimed that they had not bothered to prepare before voting, and such proceedings diverted their energies away from legislative business of greater concern to their constituents. Others argued the proceedings restored their confidence in the Senate 's institutional competence to conduct them.
It is designed as a method of national inquest into the conduct of public men”. Later on in the speech, Jordan speaks about impeachment again and states “A President is impeachable if he attempts to subvert the Constitution”. She provides a clear definition and even states James Madison’s view of impeachment when he was at the Constitutional
Donald Trump will destroy this country if he’s elected President. This Presidential Campaign has proven it. He’s a reality television host not the person that should be our next President. All of his “qualities” are perfect examples on why he shouldn’t be President. Trump is not suited to be the next president.
