What is rape? Rape is defined by Merriam Webster as a verb, to seize and take away (MERRIAM-WEBSTER'S , 2017). This is a very good and accurate explanation of the word “rape”. The reason being the victims of rape are seized and forced to partake in acts of sexual violence or assault. Even though these crimes are awful and disgusting to say the least, everyone knows what rape is and has heard of the effects. With rape just as murder, there are many different types of rape. For example you have prison rape, where another inmate rapes another inmate, quite often in the news you can read about this or it is portrayed in movies such as the title “American History X”. It happens because someone wants something (sexual acts) and they can’t get this without the consent of the other member or they need to take it by force. Mandy Boardman, mall business woman and mother, was happily married to her husband, David Wise, the man she thought she loved and trusted. “We had a happy marriage for a few years, and then we began to drift apart. Our lives were consumed by everyday events — children, school, work, sports — which meant we were a typical married couple working on raising a family and living a normal life. ” (Boardman, 2015). As it was said previously 30% of rapes are committed by partners. So why are women not reporting these crimes that are happening to them? Many women our under the belief it is part of their wifely duties to have sex with their spouses, even if it is violent sex and unwanted. As I spoke of India previously, many religions outline sexual acts as a duty for wives. Women from religious backgrounds are more likely to accept marital rape because they fear being divorcde or having a spouse that commits adultery. In addition, with only recently with in the past 15 years law have begun to offer wives protection from their husband's sexual attacks, and many people may be unaware that marital rape is a crime. Some women do not have the finical means to get away. They may have children and fear for their safety and well-being. If they left they would lose the security, so that is why they endure. Lastly the simple fact of love. A spouse may feel that their love and loyalty overrides the pain and suffering that they have to go through. Rape A person commits a felony of the first degree when he engages in sexual intercourse with another person not one’s spouse: (1) by forcible compulsion; (2) by threat of forcible compulsion that would prevent resistance by a person of reasonable resolution; (3) who is unconscious; or (4) who is so mentally deranged or deficient that such person is incapable of consent. While the laws that govern rape have changed dramatically since the 19th century, the general premise of rape hasn’t. Men are still using the same 200 year old tactics to rape and dominate women. They are exploiting close relationships for an easier rape. Men continue to belittle women by convincing them that they are dependent upon men in order to survive. Victims are have self-learned through society’s response towards sexual assault and rape is to keep quiet and to be ashamed that it happened to them. Victim’s result to blaming themselves and thinking things such as: “I drank to much”, “It happened because of what I was wearing”, or “I didn’t fight back hard enough”. In countries such as the Democratic Republic of Congo and Dar Fur sexual assault and rape cases are not talked about or ever recognized, but used as a weapon of war. In Spain and the United States such cases can be brought to trail but are extremely hard to try in court.
The Rape Shield Law was enacted to protect the rights of rape victims and to encourage rape victims to come forward that might not otherwise do so for fear of their past sexual history coming to light. Some of these rape victims are afraid that their private sexual history or previous sexual encounters will be brought up in court or become public knowledge. Many times the fear of exposure and shame could prevent victims of rape from coming forward and making a complaint to the police against an assailant. With the introduction of the rape shield law a reluctant victim might be more willing to come forward and file a complaint.
