First of all, sport decisions usually rest on questions of fact rather than questions of law. Sport law disputes require knowledge of sport which is not always the case in the ordinary court system. CAS arbitrators are selected from a list of people appointed for their competence in legal matters and because of their knowledge of the problems connected with sports activity. Conflicts, in particular those involving broadcasting or endorsement can involve huge monetary amounts which make litigation undesirable. Also disputes relating to sport require quick decisions which litigation cannot deliver. (A) After reviewing the case that was given to us, I do not believe we have enough valuable information to fully comprehend what had happen that night Sarah Smith got struck in the head with a hockey puck. But given what we do know, there is no way that Sarah’s estate can bring a claim against the Blue’s organization for hiring Kyle Albert. It was clearly an accident, there was no way Albert had intentionally deflected the puck into the stands to purposely hit Sarah. On the other hand, Sarah’s estate can bring a claim to the Blue’s organization for owning the hockey arena because it obviously wasn’t a safe area for fans to be in.

Some think that athletes should be able to live their lives however they please, not worrying about how their actions may affect other people; however, it is important for athletes to understand that many people are watching them and that their actions do have large impacts on society. Professional athletes’ image affects today’s society and youth because they influence drug use, attitude on and off the field, and contribution to the community. Relating this concept to athletics seems a bit perplexing at first, since government and sports usually do not go hand in hand. But in order to display bureaucracy’s influential role in athletics, it is vital to understand where the connection even began. As this bureaucratic type culture continued to envelop much of America, the structure and development of sports followed shortly thereafter. In an article by Barrie Houlihan, he states the emergence of bureaucracy in sport has been the product of the same forces that promoted it in work and other areas of society, namely the growth in size of administrative units, the development of a money economy, the increase in occupational specialism, and the dominance of the profit principle.
