The Common Law
The Common Law (Aarbo, 2015 ) is a system where law is based on the previous decisions. The judge is asked to decide, the judge set out the logic and must reason that he or she used to arrive at the final decision. The body of decisions made by judges is what we call case law. The principles in common law are similar facts that should make the decisions similar. That being, to be consistent. The judge must look at the past decisions to make sure that his or her follow the same logical decision and reasoning. Also, it’s a tradition of adhering to earlier case law, this can be called precedents, and it is referred to as the stare decisis.
