In 2009, Black Eyed Peas released their fifth album “The E.N.D” including a song called “I Gotta Feeling”. The song remained #1 for 14 weeks on the Hot 100 list and has over 6 million digital downloads. It was also nominated for the Record of The Year and won Best Pop Vocal Album at the Grammy Awards in 2009. On November 19, 2010, Bryan Pringle filed a First Amended Complaint against the Black-Eyed Peas, EMI April Muisc Inc., Interscope Records, and several co-defendants (including David Guetta). This started the case of William Adams (Will.I.Am) and Bryan Pringle. In 1998, Pringle wrote a song called “Take a Dive”. Pringle sent in a CD with the NRG files that contains 134 digital photographs dating back to September 1999 and NRG files dating back to August 1999. In 2011, he claims that he got a new hard drive, he made copies of “relevant files” from his old hard drive instead of the entire hard drive. The defendant then explained that the date and time stamp for the files can be changed easily, like “changing the clock on your computer” (Bryan Pringle v. William Adams, et al. ["Black Eyed Peas'], 2012). The evidence provided was not the entire hard drive, only “relevant files” that was in favor of Pringle. The defendant demands to review the original computer managing the burn of the CD and inspection of Pringle’s computer equipment used from 2009 to 2011.
