COI Donnie Piveral began his career with the Department of Corrections on December 1, 2014 at Maryville Treatment Center. COI Piveral is currently assigned as a Utility Officer on third shift. His probationary period completion date is originally August 31, 2015. Over the past several months, supervisory staff has been monitoring COI Piveral 's work performance.
Sgt. Gurniak ordered that P should be arrested for violating the order of protection causing P to threaten MOS and spit at them. P was placed in the back of a RMP and during the drive to the precinct P continued to threaten and yell at MOS. P also kicked the RMP’s rear passenger-side window causing the window’s glass to shatter and strike MOS De La Cruz in the face. Then, P also attempted to break the rear driver’s side window.
On 09/18/2016, at approximately 2148 hours, at the Durango Jail located at3225 W Gibson Ln Phoenix, AZ 85009 an Inmate/Inmate fight had occurred in Durango 3 B Pod between Inmate Moothery, Naz T303229 and Inmate Sams, Worine T284566. Upon entering Durango 3 B Pod, Inmate Sams approached Inmate Moothery and begun fighting by Durango 3 B Pod door. Multiple strikes were thrown by both inmates until Inmate Moothery had fallen to the Pod floor. At that time Officer Serrano approached the pod door and gave both inmates commands to stop fighting. No radio call was made due to both inmates complying with the orders given.
INVESTIGATION: On 07-15-16 at approximately 0823 hours, Officer Harrell #3441 and I were dispatched to 1716 Newport Avenue for a court order violation investigation. Dispatch advised us that Suspect Gerardo Jimenez was sitting in a white Dodge pickup truck directly in front of the residence. Suspect Jimenez has reportedly been known to be violent and breaks miscellaneous items.
10 Investigative Skills (7PA0006337) - Officer Stark responded to a PC211-Robbery radio call at 1038 E. Colorado Blvd. The comments of the call stated 2 Female Asians and 2 Male Asians pushed the Victim out of his wheelchair and took his wallet containing $25. Stark responded to the location, even though it was out of his beat, and asked me if he could handle the call. I advised the beat Officer that we would handle the incident for training. As we entered the Rite Aid, the Victim was sitting in his wheelchair directly in front of the exit.
MOS Wesolowski was driving MOS Diana Pichardo and observed P in the outside courtyard. MOS Wesolowski had previously arrested P for trespass at the location and had knowledge that P was issued a NYCHA Trespass Notice. MOS Wesolowski states that he called
While on station after transporting Deadrick Allen, this officer (Ofc. J. Jaques #64) was told by Det Sgt. Sibley #42 to place Allen into cell #3. While in the process of searching Allen 's person before placing him into the cell I located a small ziplock style baggy filled with a green and brown plantlike substance in his front right small front pocket. After removing the baggy Allen began being uncooperative.
However, the case was later dismissed because the District Attorney advised Dossey that the consent by Mrs. Sibley appeared to be coerced and thus the firearm had to be suppressed. I knocked on the door, announced I was the Police, told Oleg he was under arrest for an order violation, and advised him to come outside. I heard a male inside the playhouse ask multiple times why we were there, and heard someone walking back and forth inside. After a few minutes, a male, who identified himself as Oleg, came outside. I placed Oleg into handcuffs and again advised him he was under arrest for violation of an order. Officer Benavente advised Oleg of his Constitutional Rights, and Oleg said he understood and was willing to speak with Police.
At approx 1:15 pm ON 8-29-16, I was sitting at my desk in my office with the door closed. I heard the raised voice of someone I didn 't recognize yelling repeatedly, "get your hands off me" and similar variations of the demand. I did not hear any other voices. I then opened the door and left my office to find Ofc Jaques searching a male black subject who was now found to be the source of the yelling. Ofc Jaques could be heard sternly but calmly giving orders for the subject to comply with his orders in order to be searched prior to being held in the nearby cell.
Because Amanda pushed Kalvin and ripped his jacket by grabbing hold of it, there was probable cause to arrest Amanda for RCW 9A.36.041 DV Assault 4th Degree. I advised Amanda she was under arrest and Officer Michels placed her into handcuffs. I advised Amanda of her Constitutional Rights from my pre-printed Miranda card. I asked Amanda if she understood her rights and she stated "yes". While arresting Amanda, she stated she needed belongings from inside, such as a coat and her driver's license, to go to jail with her.
