Robert Sander who committed a crime in New York State. One of Three LAPD Officers arrested Kerry Sander mistaken his identify him as Robert Sander. The officers sent Kerry to New York where Kerry remain incarcerated until 1995. Robert Sander was later arrested by Drug Enforcement Agent. Mary Sanders Lee is the mother of Kerry Sanders and she also Kerry’s Conservator and the Estate of Kerry because of his history of mental health illnesses. The defendants LAPD and NY Corrections appeal the District Court. Issue: The District Court dismissed all claims against NY Corrections and LAPD for lack of subject matters such as jurisdiction. The district Court also dismissed all federal claims against the defendants. Yes, the court made the right decision to dismiss the claims made by the defendants. Holding: The district courts affirm and reverse parts and further the proceeding that consist of the subject matter. Therefore, the district court must review claims from both parties.
