On 02/25/2016 at approximately 04:32 hours I was dispatched and responded to the docks to the rear of the seaside inn located at 5330 Treadway Avenue. in the City of Port Richey. Upon arrival I made contact with the complainant/witness Daniel Guess.

Daniel stated that he was in the cabin of his boat which was docked in an adjacent slip behind the Seaside Inn. Daniel indicated that the boat ("Paladin") next to his collided with his boat. Daniel advised that he exited the cabin to assess the situation thought the "Paladin" had broken loose from it 's mooring. Daniel stated that there was someone on the "Paladin" at the time and he initially thought that it was the vessel owner attempting to secure the boat. Daniel indicated that he then made contact with the person onboard the vessel and realized that it was not the boat owner. Daniel indicated that he then contacted the police department to respond to the scene.

We were then able to launch the police department patrol boat and respond back to the scene. As we were in the process of launching the patrol boat, I was advised via radio by Officer Barcelo that Jason had fallen into off of the boat into the water. Upon arrival back at the vessel the I observed Jason chest deep in the water clinging to the stern of the vessel. As the patrol boat was maneuvered closer I was able to pull Jason to the patrol boat with a boat hook and then pull him from the water onto the patrol boat. He was then handcuffed and taken into custody. The owner of the vessel was then transferred onto the boat to ensure that it was not taking on water and attempt to free it from the broken submerged
