The 4th Amendment states that “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall be issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. In most incidents people undergo excessive force, false arrest, and malicious prosecution when experiencing police brutality. Often there has been cases where officers has became aggressive and defensive with people when they’d ask them excessive questions or refuses to do what they’ve ask. People has been falsely arrested just because of the way they’d approach the an officer or the tone they gave them. That same night Sean Bell was having if bachelor party. One of the detectives over heard one of Bell’s friend saying they were going to go get their gun, due to a situation that happened earlier that night. The detectives later questioned Bell and his friend while they was in there car about if they had a gun and ask them to step out the car but they refused. Bell started to drive off, but the other detective thought he had seen a gun in the backseat, so all of a sudden they fired 50 times at vehicle killing Bell and his friend. Yes the detectives did have a civil duty and power to protect individuals that night, but they did not have to overuse their power .A primary purpose of the Nation’s Civil Rights Laws is to protect citizens from abuses by the government, including police misconduct.
