Citizen Complaint To The Pomona Police Department

Mr. George Ricks submitted a citizen complaint to the Pomona Police Department on December 15, 2016. In the complaint, he alleges that Officer Austin Dossey entered his apartment without a search warrant. Ricks alleges that Dossey recovered a firearm from inside his bedroom even though Ricks told Dossey that he could not search the apartment. Because of the illegal search, the court dropped the charges for an ex-felon in possession of a firearm because the evidence would need to be suppressed.

INVESTIGATION:

Internal Affairs received this complaint on January 24, 2017. Mr. Ricks was contacted via telephone and an interview was set with him for February 14, 2016.

George Ricks on February 14, 2017 at 1307 hours. The interview took place in the Internal Affairs office and Sergeant Michael Neaderbaomer was also present. The interview was digitally recorded and a copy of the interview will be kept in the Internal Affairs office for future reference. The following is a summary of the recorded interview of complainant George Ricks:

Mr. Ricks filed a citizen complaint after the public defender assigned to his case suggested he make a complaint against Officer Austin Dossey. The complaint was for Dossey’s conduct and illegal search of his bedroom that occurred on 9-29-16 when Mr. Ricks was arrested. Dossey’s statements were captured on his MVS audio recording of the incident which were played in court to dismiss the charge of an ex-felon with a gun. Mr. Ricks believes that Dossey lied in his police report because he could not see the gun in plain view inside his dresser drawer from the threshold of his bedroom door.

In this incident Mr. Ricks was detained by officers outside his apartment at 1482 Cordova St. after his girlfriend Ms. Bonita Montoya, who lives in Apartment #4 upstairs, called the police after a domestic dispute.
