Kerry Max Cook is a former inmate on death row of 20 years in a Texas prison after being convicted of rape and murder. He was later exonerated of the murder by DNA evidence. In his youth he carjacked a vehicle that belonged to a sheriffs deputy and in the opinion of that sheriff he was label a criminal. At a party he met a girl and went up to her apartment and made out with her and he ever saw her until months later. He was convicted based on his fingerprints in her apartment. As cook was living in the same complex at a friends place he was an easy pick for the murder. The defense tried to argue you can’t prove the period of a fingerprint. A Florida police officer and his friend approached the car on a routine checkpoint. The police officers were shot with Jacobs gun. Rhodes and Tafero took off in the police vehicle and Jacobs followed. Police later found the gun used to kill the officer and his friend in Tafero’s waistband. This was at roadblock after the individuals had kidnapped another man and stealing his car at a roadblock. Sunny and Jesse both blamed Rhodes for the murders whereas he blamed them for the murders. The prosecutors offered Rhodes a deal to testify for second-degree murder, which he took. Gun residue test were taken and though Rhodes was the one who tested the most positive there was a slight police match for Jacobs as well as Tafero. Sunny later lied to the police claiming to be a hitchhiker at the time so she was proven to not be trustworthy. Based on his testimony both were placed on death row where Jesse was killed in an extremely violent way.
