This essay will provide a critical analysis based upon a created organisation. ‘Country Australia Remote Education Support’ (CARES Inc.) was created to ‘offer support services to the parents and children from remote areas, transitioning into boarding school’ (CARES Inc. mission statement) This organisation is a non-profit, government-funded organisation, located within the Gold Coast. The chosen structure of CARES Inc. will be analysed, and explained throughout. If an organisation fails to follow legislative laws then they may face serious penalties (Queensland Government, 2016). Cares Inc. has a number of legislation and statutory obligations as an organisation. This essay will focus on three key Acts and provide a brief description as to why and how they will affect CARES Inc. As CARES Inc. is a non-for-profit organisation, the Australian Charities and Non-for-profits Commission (ACNC) has appropriate legislation that CARES Inc. must follow. The ACNC as their own organisation, has a list of aims in which are targeted to assist organisations to follow the necessary legislations that charities and non-profit-organisations are required to abide by. To become a charity or non-for-profit organisation, they must first register with the ACNC. Therefore, the ACNC is extremely important for all charities and non-for-profit organisations. Throughout the life of the organisation, they must follow the model rules set out by the ACNC as one of the statutory obligations of an organisation (Australian Charities and Non-for-profits Commission, 2014). The Australian Charities and Non-for-profits Commission Act, 2012, provides the necessary legislation that CARES Inc. must obey (Australian Government, 2012).
