Cyber Charter Schools and Students with Disabilities: Rebooting the IDEA to Address Equity, Access, and Compliance aims to open the conversation about the new and emerging issue of special education in cyber charter schools (CCSs). There is currently very little literature available. This article looked at weather the Individuals with Disabilities Act and IDEA 2004 requirements are being met in CCSs or if these schools are contributing to educational segregation because they are unable to fully comply with the IDEA. IDEA 2004 did not take into account the actuality of CCSs when revamping the bill, and especially not for students with disabilities. One of the most important things an inclusive classroom teaches is the ability to develop social, interactional, and communicative behaviors. This is not meaningfully possible in a CCS because educators are not able to observe or guide their behaviors. This is a common, and fundamental goal included in many IEPs. Since CCSs are not able to fully meet it, should it be left off the IEP of CCS students? Along with IEP conflicts, CCSs contradict the goals of the IDEA through the LRE as well as Child Find. Child Find requires schools and school districts to identify and evaluate students who might need special education services. The IEP then outlines the student’s unique needs and goals, as well as what services will be needed to accomplish them. The LRE will then be determined by evaluating Child Find and IEP then placing the student in the environment that is least restrictive in which they can succeed.
