Discrimination against Expecting Women at Workplace: A Case Study

ABSTRACT:
Motherhood is considered to be a very special experience in every woman’s life. Maternity benefit act, 1961have been enacted to protect the employment of women in certain organizations for specific time period before and after the birth of child and to provide for maternity and other benefits. Despite the enactment and application of this act, expecting women still face discrimination relating to employment and maternity benefits and have to fight for their basic rights.
The present paper attempts to discuss two cases, one from Insurance company- Mrs.Neera Mathur vs. Life Insurance Corporation of India (LIC) and second from Delhi based design firm - Idiom consulting company vs Indrani Chakraborty case highlighting the discrimination faced by expecting woman at their workplaces.

Neera Mathur applied for the position of an assistant with Life Insurance Corporation of India. She appeared for written test, interview and successfully cleared both. She filled up employee declaration form and submitted to the LIC on May 25, 1989. She underwent medical examination on the same day by a lady doctor who was on the panel of Life Insurance Corporation and was found medically fit. After that, she attended a short-term training program and received letter of appointment dated September 25, 1989. She was kept on probation period for six months and was permitted to be confirmed on the job, subject to satisfactory work
