The case, “Ebony - R v BW & SW” was a murder/manslaughter due to starvation, of a child. The conviction of murder sentenced to SW, the mother was lifetime imprisonment, and the father BW, was convicted of manslaughter, sentenced to 16 year imprisonment with a 12 year non-parole period. The trial was about a seven year old child who was starved to death either by negligence or deliberate omissions. The judgements on the convictions were quite effective as the case was very severe as the criminal offence was the worst case in both categories of offences. Though SW, the mother tried for an appeal and also sated in her previous trial that she was heavily influenced on prescription medicine so she didn’t notice her daughter was close to death. …show more content…
The parents were not concerned about Ebony or having no parental enthusiasm and lived in an under stimulating environment, reportedly she was locked in her room until she passed away, weighing 9 kilograms as a small child who did weight 20 kilograms, last seen by doctors in 2006 also the DOCS (department of community services) has constant surveillance of the family, even before Ebony was born though the family avoided the discovery of their child as excusing the matter like saying Ebony was sleeping in her room they had medical appointments or are not present in their home. The parents neglected their child, giving Ebony no rights in life which must be treated as a severe criminal conduct as the family was already suspicious in their acts. Revealing they either had an intention to kill, or had realisation the probability of death. Especially the condition when ebony was found in, malnutrition, starved, dehydrated as pathologists reported that she has emaciated skin features and chronic nerve
