These sources include Case law (Judicial), Statutes, Constitution and also administrative regulations. The legislative bodies often pass status. These bodies include State legislatures, Congress and also the county and municipal governments. These bodies pass statutes that apply to the whole country (Boer, 2009). Every group of health care professionals that are licensed by the state or the government has laws and regulations in place that outline the scope of practice. The constitution law provides for the right to life of every individual. This, therefore, requires nurses and different health services practitioners to protect life at all cost (Boer, 2009). The state law affects how nursing is practiced. In 1975, nurses were identified as professional and even identified of being worthy of protection that is provided in the law. On July 9th, the same year, negligence claims against nurses also came up. This negligence was characterized as malpractice. The most important and the most controversial topics that come up are medical malpractice and medical ignorance. Nurses are therefore required to be very careful while performing their duties. Negligence is often defined the omission of the utilization of care and caution. Malpractice, on the other hand, is described as the unethical and improper practice of one’s profession. This could be due to lack of proper skills (Shecaira, 2015). The term malpractice is mostly used to describe cases that involve professionals while negligence is used in describing cases involving professionals and non-professionals. Negligence can also be described as not doing the right at the right time of the circumstance. Also, malpractice can be described as professionals not doing the right task at the standards of care while causing harm to the clients; this could be because of the lack of skills in the profession. Medical Negligence occurs when a medical professional ignores their responsibilities and by causing injury or even indirect death. These professions do not intend to cause harm to the victims but due to ignorance and lack of action, they end up harming them. Medical ignorance cases may involve unintended oversight or mistakes (Shecaira, 2015).
