A domestic violence restraining order is a court order that helps protect people from abuse or threats of abuse from someone they have a close relationship with. You can ask for a domestic violence restraining order if: A person has abused (or threatened to abuse) you. You have a close relationship with that person. You are: Married or registered domestic partners, Divorced or separated, Dating or used to date, Living together or used to live together(more than roommates), Parents together of a child, OR Closely related (parent, child, brother, sister, grandmother, grandfather, in-law).

Maria Navarro was celebrating her birthday with her relatives and friends in her home in East Los Angeles when she received a phone call from the brother of her estranged husband, Raymond Navarro, warning her that Raymond was on his way to her house to kill her and any others present. Maria immediately dialed 911 to request emergency assistance. She told the 911 dispatcher that she had just received a warning that her estranged husband was on his way to kill her, and that he was under a restraining order. When Maria stated that her estranged husband had not yet arrived, the dispatcher responded, “O.K., well, the only thing to do is just call us if he comes over there․ I mean, what can we do? Restraining order violations should be judged by criminal courts according to the text an argument can be made that criminalizing the violation of a civil restraining order might limit its ability to protect victims. I disagree I don’t believe it will limit its ability to protect victims but encourage more victims to come forward and offenders will be punished for violating the order which will prevent them from further abusive to the victims.To be truly effective and enforced, police departments must have obtained copies or at least have a readily available reliable source of the terms of the order. (Buzawa, Buzawa & Stark, 2012.p.291). Looking into our case of Maria Navarro the police officers had ample time to pull up or retrieve the restraining order and send out an officer to Maria House. As well as in the case of Gonzales v. City of Castle Rock the restraining order had just been put in place permanently the day before Mrs. Gonzales called and informed the police department of the restraining order and the terms yet nothing was
