I believe in Gay Marriage. I feel that every human being has a right to make his or her own decisions, and that involves their choice in marrying whomever they want to marry. In the article, “Gay Marriage, an Oxymoron” Lisa Schiffren shows how she argues that same gender couples should not marry. Lisa Schiffren states that marriage should be between Man and Woman. I disagree because in the Declaration of Independence it said, “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” What this means is that human beings are free to choose what makes them happy. I disagree with what she states because, Marriage is not only for procreation, otherwise infertile couples or couples not wishing to have children would be prevented from marrying. From 1970 through 2012 roughly 30% of all households were married couples without children, and in 2012 married couples without outnumbered married couples with children by 9%. 6% of married women age 15-44 are infertile, according to the U.S Centers for Disease Control and Prevention. Also in a 2010 Research center survey, people rated love, commitment, and companionship higher than having children as “very important reasons to get married.” Only 44% of unmarried voted for love, commitment, and companionship. 59% of married people rated having children as a very important reason to get married. The U.S Supreme Court ruled a case in 1974 called the Cleveland Board of Education, which was, “Freedom of personal choice in matters of marriage and family life is one of the liberties protected by the Due Process Clause.” Judge Vaughn Walker wrote in California banning Gay marriage was, “Unconstitutional under both the Due Process and the Equal Protection Clauses” (Vaughn Walker). The Due Process Clause in both the 15th and 14th Amendments of the U.S constitution states that no person shall be, “deprived of life, liberty, or property, without due process of the law.” The Equal Protection Clause in the 14th Amendment states that no state shall “Deny to any person within its jurisdiction the equal protection of the laws.
Marriage is an internationally recognized human right for all people. Since 1888 the U.S Supreme Court has declared 14 times that marriage is a fundamental right for all. In the article 16 of the Universal Declaration of Human Rights guarantees, “Men and Women of full age without any limitation due to race, nationality or religion has the right to marry and to found a family” (United Nations).
