2.0 THE DIFFERENCE BETWEEN GENOCIDE, CRIMES AGAINST HUMANITY AND WAR CRIMES
The terms genocide, crimes against humanity and war crimes are always mistaken as carrying the same meaning or same context. These terms carries different meaning from one another and has their specific meanings. The only similarity between these three terms is that all of them fall under the category of international crime.
As been explained earlier, the term genocide refers to the demolition of a certain group of people which always come with mass killing. Genocide too called as ‘the crime of crimes’ other than being labelled as the extreme crime against humanity as it intends to exterminate a part of humanity. These rules are laid down under several international agreements which aimed to give protection to the civilians, women, children, prisoners of war, sick and wounded armed individual. The acts such as torture, destruction of property, cities, towns and villages, killing of civilians and similar acts also considered as war crimes.The differences above show that the genocide crime is narrowed to the intentional killing of a portion of certain group or class of people. In sum, the actus reas and mens rea are the vital factors that differentiate the meaning and context of the abovementioned terms.
2.1 FUNCTION OF THE CONVENTION ON THE PREVENTION & PUNISHMENT OF THE CRIME OF GENOCIDE
