INTRODUCTION: This case involves suspect Heathcliff Cruz being arrested and booked for threatening to kill his mother, victim Margretta Montalbano when she refused to take him to the liquor to buy cigarettes. LOCATION DESCRIPTION: The location of occurrence is a one-story single family residence located at 465 Westgate St., Pasadena Ca 91103. The residence is located mid-block with the front door facing southeast. The residence has two bedrooms and a fence around the property. EVIDENCE: INJURIES: Suspect Cruz sustained an approximate one inch laceration to his left hand when he punched out a window. SUSPECT HEALTHCLIFF CRUZ’S STATEMENT: I read Cruz his Miranda Rights and said he understood his rights. Cruz told me the following in summary. Refer to my body worn camera for further details on Cruz’s statement. Cruz told me he cut his hand when he punched out the living room window because Montalbano had locked him out. Cruz said he was very upset because he pays for the rent. I asked Cruz if he had ever been physical or threatened Montalbano before and he said something to the effect of, “No, my mom is a lying bitch and she makes up stories. I’ve only pushed her.” I asked Cruz if he had ever choked Montalbano and he said, “No, that’s a dumb question to ask.” I continued to question Cruz and he said something to the effect of, “You’re asking dumb questions and I’m going to be quiet now.” Cruz had nothing further to add. Officer Poirier and I transported Cruz to Pasadena City Jail where he was booked for PC 422 – Criminal Threats. Montalbano wanted a restraining order taken against Cruz.
