In 1989, Rosanne Hendrick started as a full-time emergency dispatcher for the city of Pittsburgh. In 2003, she noticed that some of her co-workers and supervisors were performing illegal gambling activities at the emergency operations center and decided to take action and file a claim against her team members. Her co-workers found out that she had reported them and decided that they would retaliate against her which led to her termination in 2004. Rosanne filed for a grievance and while this was in motion the city was merging its systems with Allegheny County. The City of Pittsburgh were going through a merger and told her that she would be put on a transfer list to Allegheny County with everyone that wanted and were eligible to transfer. Rosanne accepted this offer to be transferred once the grievance was completed. When her grievance was over and went back to work, the City of Pittsburgh breached the contract by not including her name on the list of people that wanted and were eligible to be transferred to Allegheny County. She learned that everyone on the list made it to this County except for her. In this case, there was consideration involved when they promised her a job and she would perform the work required of her. This is an important element of a contract because this will distinguish whether or not a contract was formed. She had the legal capacity to enter into this contract because she had an understanding that once her grievance was over she would return back to work. Therefore, this case is considered a breach of contract because one of the parties involved did not perform their obligations under the contract without a legitimate excuse. Hence, Rosanne winning this case and is receiving monetary damages for the loss in wages and
