In the early days of the United States, the need for a stronger framework to govern the nation became clear. The Articles of Confederation are not a real government doctrine. It lacked the use of legislation and was very hard to amend. Therefore, the Constitution was created to fix the problems the Articles of Confederation fabricated. The principal problems that needed to be fixed were republican, confederate, and federative issues. The Republican issue involved what went on inside the state, interstate. The most pressing concern on this issue is popular sovereignty. The United States needed to create a government for the people, by the people. The Constitution sought to do so. The confederal issue was an issue of power between the states, intrastate. At the time, the separation of powers gave the states much more power than intended. To help control the power that the states hold, checks and balances were created. Checks and balances limit what each branch of the government can do. It also lets each branch have the capability to check the other branch to avoid one becoming too powerful. The concept is outlined in Article I, Section 1 of the Constitution, which established the principle of bicameralism. This concept divides the legislative branch into the Senate and the House of Representatives to limit its power. Another example would be Article II, Section 2. This section focuses on the Senate's ability to approve or reject the president's judicial nominations. The federal issue was the least controversial nationwide, but it still needed to be controlled. To have a functional government, the power needs to be distributed fairly. Therefore, enumerated powers were added to the Constitution.
