The Bill of Rights is the first 10 amendments in the constitution, added to appease the anti-federalist, who thought the government had too much power. The Bill of Rights are largely debated and open to interpretation in many court cases today. The 4th amendment is the right to privacy in your home and to yourself and your property, and the need of a warrant to conduct a search. The word “search” is very open to interpretation, much like it was in the Maryland V King Supreme court case. Alonzo Jay King Jr. was arrested for threatening others with his shotgun. In today's’ world, privacy is becoming a bigger concern but is growing increasingly more non-existent. We store fingerprints on our phones, our and our passwords online, and many other things that used to be kept very private and personal. There are hundreds of to get DNA from someone that are non-intrusive, like getting their fingerprint from a phone or getting saliva from food or drink they had. The 4th amendment protects citizens from unlawful and warrantless searches, but with the amount of DNA that one leaves behind everywhere they go, your DNA is not really considered private anymore. Another reason why is because, in the majority opinion, Justice Kennedy writes that, “the use of DNA for identification is no different than matching an arrestee’s face to a wanted poster of a previously unidentified suspect.” Very few people would consider taking a photograph of a suspect a violation of their 4th amendment right. Moreover, if the DNA swab was used for identification purpose, which you could argue it was, it is completely legal and constitutional. Arguing that it was unconstitutional because there was no probable cause or suspicion is also false. In this case, he was threatened many people with a deadly weapon. The DNA test can link him to his history to find out if he has any mental disorders, or another history of violence so they know who and what they are dealing with.
