Yes, the Giver could have been a bad guy for three reasons or examples. He shared memories and feelings with Jonas including the sled scene, where Jonas FELT cold and felt happy, “Like a grandparent, the old man is amused by Jonas' excitement, and says they can probably try another sledding memory another time.” The giver also perpetuates a society in which humans no longer possess the freedom to choose their own lives, meaning he basically controls every person's memories. But he could also be the good guy, he could have set Jonas up to save the community. So that they can have their own freedom.

He also let down the community because he took a baby, Gabriel who was supposed to be released. When you go against the town's own rules you get released and if Jonas's friend wouldn't let him go he would have been attacked and possibly killed Jonas also could have been a good guy, he saved Gabriel, all he was trying to do was start a new life with thoughts and feelings including pain. Jonas wanted a normal life, he didn't mean any harm.
Is the giver a good book/movie? Well, the book is very thought-provoking and can help us picture in our minds what the book was like in real life.
