Your Honor, and people of the jury, on December 22nd of last year, Alguinaldo Nesbitt opened his shop to many people and one man who would later kill him.The day after, he was found dead in his own store. The defendant, James King has been charged with participating in this crime of entering the drugstore, in which either he or Richard “Bobo” Evans killed Mmr. Nesbitt. The evidence will also show that Mr. James King and Mr. “Bobo” Evans stole 5 cases of cigarettes as well as all the bills in the cash register. In the following days, the defendant was arrested after it was established that he was a participant. Richard “Bobo” Evans was in a fight with a man who died. Manslaughter. There's nothing stopping him from killing again and shifting the blame. “Bobo” can be sentenced for life if murdered Nesbitt so he chose to shift the blame onto James King who was at his cousins house the entire time. “Bobo” clearly showed that he was the leader of the operation when he sold the products which showing that he is in charge of handling the robbed goods. Seeing that he was in charge of the robbed goods he got to keep them, but, King got none of the goods since he wasn’t in charge or even a participant. But, Evans testified that King was there, so King finds himself at this trial, for murder, that he does not deserve to be at. How can we trust what Evans testified when he is locked away behind bars when not at trial? Similar to Evans, the majority of the witnesses are criminals and 14-year-old Osvaldo Cruz is no different. Cruz said that he didn’t take part in the robbery for the money, but because he felt threatened by “Bobo” Evans and Steve Harmon.
