915 Words4 Pages

A witness's testimony is the evidence. The credibility of evidences is one of the most important parts of a trial. A credible witness has the first-hand knowledge of the case and accurately states the facts. They're consistent in telling and re-telling their stories. A credible witness is confident and knowledgeable. If a witness has an emotional or personal interest in a trial's outcome, their credibility can be challenged for bias. A witness's credibility is important because it can make or break a case and influence the jury's decision.

Credibility problems can arise if a witness has made earlier statements that are inconsistent with their trial testimony. In other words, the witness might not be believable if they changed their story overtime. In the podcast present by Sarah, Sarah had mentioned “At first, he [Jay] insists he doesn’t know anything about the murder. But eventually he comes clean. He tells them what happened on January 13th. A few weeks later, his story has changed.”(Serial ep.4) Some changing in Jay’s story were small and understandable, for example, his nervous in front of the police. For example, Jay had mentioned he picked up Adnan to shop in the mall, but the name of the mall he mentioned in two different interview are different, which indicated one of his sentences is wrong. Jay had also mentioned he was at the grocery store when the police called, but in second interview, Jay said he was at a friend's department. This call should be an important memory that he shouldn’t forget, but the …show more content…

“A witness’s credibility enhanced when his testimony matches known evidence”( Serial: Why Jay's Testimony Is Not Credible Evidence of Adnan's Guilt). Jay’s testimony about he buried Hae’s body was corroborated by the fact he knew where she was buried. And his testimony about he ditched Hae’s car was corroborated by the fact that he knew where her car had been left. Some people might rebuttal that this testimony matched with know evidence, which increase Jay’s credibility, but there were still other evidence that can not be verified by known evidence. These testimonies corroborated to Jay’s involvement in Hae’s murder, but not Adnan’s involvement. Not a single claim that Jay has made about Adnan’s culpability for Hae’s murder can be verified by independent and external evidence. For example, the cell phone records shows no calls from seven to nine P.M., which his testimony about Adnan was in Leakin park during this time could not be verified, and there were also no physical evidence or eyewitness that connected Adnan to the crime. Which Jay had less credibility on the testimony he said about Adnan’s
