United States, 323 U.S. 214 (1944) Procedural History: Fred Korematsu was a Japanese- American who was sent to an internment camp following the enactment of Executive Order 9066 in 1942. This executive order required that all Japanese- Americans, some Italian- Americans, and some Jewish refugees be taken from their homes and placed in internment camps around the United States, with many being on the West Coast. This was in response to the attack on Pearl Harbor and was intended to prevent supposed espionage. Korematsu v. United States was a controversial landmark decision ruling by the United States Supreme court. Fred Korematsu was a Japanese-American living in California, he was ordered to refuse to leave his city after the Japanese internment camp. After the World War II, President Franklin D. Roosevelt issued the Executive Order 9066 and Congressional decree gave the military power to exclude citizens of Japanese descent from areas deemed critical to national defense and may be vulnerable to espionage. On May 3, 1942, Fred Korematsu stayed in California and violated the US Army Civilian Executive Order No. 34. This supreme court case has an importance of interpreting the constitution and the different perspective of interpreting the constitution based on a person’s own political background and beliefs.
In the case of Japanese Americans, they were able to receive some levels of equality among whites. In the article, “No Jap Crow’: Japanese Americans Encounter the World War II South”, author Jason Morgan Ward looks at how Japanese Americans were treated during the Second World War in the American South, and how they were allowed to be considered semi-white. In his thesis Ward said, “This episode revealed the increasing inability of southern white leaders to defend the segregated status quo, even as it exposed their segregated society to comparisons with fascism. At the same time, in trying to make Japanese Americans behave according to the Jim Crow script, white leaders foreshadowed the ways they would later react to the protests of the civil

The Court аligned this case under the lаnguage of Plessy v. Ferguson, which it sаid involved the "more difficult question" of segregаtion on railway carriers. Before, during, and long after the Civil War blacks were discriminated against in almost every form of life. They had to fight and be patient to be accepted as equals among their white counterparts; this process took form over a long period of time, and after many failures, blacks were truly equal in the eyes of the government. The thirteenth, fourteenth, and fifteenth amendments which were passed in the late 1860’s were supposed to bring political, social, and economic equality for the blacks; however, this was not the case, while in some facets of life blacks obtained more freedoms they had to wait many years after these amendments were passed to be fully equal to whites. The thirteenth amendment abolished slavery in the United States.
The ruling thus lent high judicial support to racial and ethnic discrimination and led to wider spread of the segregation between Whites and Blacks in the Southern United States. The great oppressive consequence from this was discrimination against African American minority from the socio-political opportunity to share the same facilities with the mainstream Whites, which in most of the cases the separate facilities for African Americans were inferior to those for Whites in actuality. The doctrine of “separate but equal” hence encourages two-tiered pluralism in U.S. as it privileged the non-Hispanic Whites over other racial and ethnic minority
