At 4 a.m. on October 12, 1988 an African-American man with a gun attacked a 30-year-old White woman as she returned home after using a payphone in Nashville, TN. The man led the woman to a secluded area behind a bar, where he forced her to remove her clothing and then raped her. He also stole $75 from a purse she was carrying, and then left the area. The woman went to the hospital, where she also met with a police detective. Detective Madison worked with the victim to make a composite sketch from a composite kit in an effort to recreate the face of her attacker. Two weeks the victim was called into the police station to do a photo line up. Det. Madison laid 6 pictures down in front of the victim (simultaneously) and asked her if she recognized any of the men in the photos. The victim studied the photos for about two minutes before picking Chris Jones out of the line-up. He asked her how confident she was and she said “very confident.” Two days later, the victim was also asked to view a physical line-up – where she also identified Jones. In the convenience store robbery, an African-American wearing a bandana around his nose and mouth held up the store clerk with a gun, passing him a hand written note that read “give me all the money in the register or I will shoot you.” Although the store clerk was unable to identify Jones as the man who help up the store, the detective in the case felt that this could have been due to the bandana and sought the help of a handwriting
