In the article, Unwinding Mass Incarceration by Stefan Lobuglio and Anne Piehl, they argue that unwinding the mass incarceration “well neither be cheap nor easy, and to be done responsibly will require a new infrastructure of coordinated community-based facilities and services that can meet evidence-based incarceration needs while also ensuring public safety.” Hence, their argument is clean-cut with evidence in the article to back up their argument of unwinding the mass incarceration. Similarly, a solid fill of a concluding statement upon the unwinding of the mass incarceration as stated in the article, “requires much more than stopping current practices or reversing course by mass commutations and early release programs.” Subsequently, from this article, there are numerous interesting key points, and perspective of unwinding the mass incarceration.

Diversion programs have become a prevalent form of justice in the Criminal Justice System. Diversion can be two things; diversion from jail or diversion from the legal system completely. Diversionary programs have been developed in the Criminal Justice System throughout its many levels for a multitude of reasons. Often, they are spurred on by practical concerns including, but not limited to, over-crowded prisons, the high cost of the criminal process, and as an alternative approach to dealing with those suffering from mental illnesses. Diversion may occur both before and after a trial and are aimed at avoiding the trial process (pre-trial) and incarceration (post-trial).
One possible alternative route to the prison system could be a boarding school type system where convicts are required to participate in an educational program that gives them the knowledge and ability to be released and given the needs to go make something better of the life they have been given. This system where they are required to participate in educational training would come along side a strict rule system that would encourage them to make the decision to choose something better. The debate is whether or not prison is beneficial or not for those who will be convicted, sentenced, and released. Whether we change the system or not there will always be crime and

In this day and age, There are five times as many people in jail as there were in the 1970s. Almost 5 percent of the population of the United States will go to prison at in point of their life. Conservatives believe that imprisonment reduces crime in two ways: it removes criminals from the public so they can not commit more crimes, and it also discourages people who would commit a crime as they consider the consequences. Unfortunately, neither of these outcomes have come to be true. In fact, mass incarceration and “tough on crime” laws have been extremely ineffective that instead of reducing crime, it increases it.
Introduction Crime, its punishment, and the legislation that decides the way in which they interact has long been a public policy concern that reaches everyone within a given society. It is the function of the judicial system to distribute punishment equitably and following the law. The four traditional goals of punishment, as defined by Connecticut General Assembly (2001), are: “deterrence, incapacitation, retribution, and rehabilitation.” However, how legislature achieves and balances these goals has changed due to the implementation of responses to changing societal influences. Mandatory minimum sentences exemplify this shift.

Through the decades, crime and crime control have been analyzed in an attempt to find the causes of crime and decide how to combat them. The United States showed an increase in their prison population in the 1970s when the country turned towards a more punitive justice system. Referred to as just deserts theory of crime, the aim is to inflict as much pain on the offender through harsh prison sentences, in hopes to cause as much pain as the crime they committed. The worse the crime is, the worse the punishment the criminal will endure. The issue surrounding just deserts theory is the vast amount of offenders who return to prison after being released, also known as the recidivism rate.
They have more opportunities because they have not been locked in a cell for a number of years. Instead in restorative justice the offender is required to do things like community service and communicating with the victim of their crime. Giving offenders more options after they have committed a crime can help them get back on their feet because they would have a better chance of getting a job. They would have a better chance of getting a job because they wouldn’t be out of a job as long as if they were in jail for years. Also hopefully by the offender not spending years in jail and doing things like community service they learn their lesson and will be less likely to commit another crime in the future compared to someone who spent years in jail.

One of the ways the government intervention can help overcome market failure is through the introduction of a price floors and price ceilings. If prices are seen to be too high, price ceiling or a maximum price could be imposed on a market in order to moderate the price of the product. This policy is often used when there are concerns that consumers cannot afford an essential product, such as groceries. The effect of a maximum price could create a shortage as it could lead to demand exceeding supply for that particular good.
There is a worldwide trend in the use of penal imprisonment for serious offenses as capital punishment has been renounced by an increasing number of countries. Harsh punishments include capital punishment, life imprisonment and long-term incarceration. These forms of punishments are usually used against serious crimes that are seen as unethical, such as murder, assault and robbery. Many people believe that harsher punishments are more effective as they deter would-be criminals and ensure justice is served. Opposition towards harsh punishments have argued that harsher punishments does not necessarily increase effectiveness because they do not have a deterrent effect, do not decrease recidivism rates and do not provide rehabilitation.
