This scenario would be in the top 5 of the worst nightmares that a person could experience. I am assuming that the victim of the robbery, the conveince store clerk, provided an identification statement. Ayers evidently matched the description provided and unfortunately it can be perceived tht he was subjected to wrongful arrest; in additon to he and his families Fourth Amendment rights violated. Ayers was incarcerated for nine days, without bond, before charges were dropped; in as much as, the real suspect confessed to the crime. Law enforcement was very conscientious in regards to clearing Ayers so he could be released from custody; however, Ayers and his family have been traumatized by this negative experience. Apparently there was sufficient evidence to arrest Ayers on probable cause. PC is not equivalent to absolute certainty and can exist without absoute certainty. SCOTUS issued guidelines supporting this in Maryland v. Pringle (2003) and llinois v. Gates (1983). If Ayers had been the robber, he could haved posed a threat to the community. Would I like to be privy to more details, of course I would; however, as I said, with law enforcement using this much force, PC must have been established. Lawsuits against law enforcement is difficult, since officers rely on probable cause for arrest; thereby, Ayers could not file suit for malicious prosecution and would have to pursue a civil lawsuit (Rodriguez, 2017). Although there was probable cause, Ayers could win in a civil court with jurors being sympathic to his wrongful arrest and incarceration; in addition to, the phobias and distrust of law enforcement the family is enduring due to this horrendous experience.
