I believe that it is safe to say that women have been for many years, and still is dealing with oppressions from men that were created by men. Women have been for years considered as weak and fragile, and that their place belongs in the home cooking, cleaning, taking care of their husbands and children, and to sexually please their husbands. One of those question includes, “is it consider as murder, or is it self-defense”? Many would say that it is self-defense since the woman is in immediate danger, while others would say that it is murder because she has committed a crime. This then brings us to another question. How do we justify a woman killing her abusing husband? (Rosen, 1986) wrote, “The criminal law normally penalizes those who intentionally inflict or attempt physical harm… Thus, a person who kills in self-defense will be acquitted of homicide.” (The excuse of self-defense: pg. 27). Therefore, a woman who protects herself from her abuser will be considered as self-defense, because she is protecting her wellbeing against an active aggressor. On the other hand, taking the same situation into consideration, if she had planned to retaliate, this then warrants to be a crime, because the situation was premeditated. With this law in place, women will get the justification that they rightfully deserve if they get a fair trial.
