I had to insure I was given the appropriate merit. This does not mean I believe their excuse for exclusion. As for viewing the questions, I don’t really want the questions, even though they may be nice to have. While the Ombudsman’s office sends the word to reverse the finding and consider your experience as satisfying the MQs. The selection has been made and there is no chance they will conduct another application process. I believe this exclusion was initially made with Malice. My application specifically addressed the requirements; as you have indicated. From the initial complaint, FCC Sergeant Position, running through to the latest, POIII position at FCC, their selections have all been completed. One would believe that once their selections were made, the objective “ranking” or selection order would be at hand. Thus, any use of education, seniority, or merit principles would be at hand to be readily available for anyone who may request information or wish to inquire about. This sergeant that was moved prior to the obligated time limit by ACOA & SOA contract. This in of itself is a violation and is questionable. Sgt Martin was the individual in question, he transferred from FCC where he was a Sergeant (COIII) and he demoted to a COII going to YKCC. This demotion was a grievance filed with the State and was ruled to be within agreeable standards. He was transferred to YKCC (Bethel) and didn’t like it. He did not spend the required time there (by contract), applied for the sergeant position and was selected. This is
