The defense can challenge Kendal Malone’s findings of the tire tracks behind Balmen’s house by showing how they only establish that Bratton’s vehicle was present at the scene at some point. They do not determine if the tracks were made at the time of the murder, and they only establish that the vehicle was at the scene, not Bratton. The defense should also ask why no footprints were found in the dirt. Finding footprints would confirm that someone actually got out of the car. This can help the defense by convincing jurors that it is not clear if Bratton was present at the time of the murder, and if he did pass by Balmen’s house, he never got out of the car because there were no footprints. The defense should also challenge the findings of the microphone cord and gloves. They can show how many other people in Hollyville own the exact same microphone cords. This may create suspicion in jurors that Howard, whose business was destroyed by Balmen’s review, had the microphone cord which may have been used to kill Balmen. The defense can also point out how Balmen’s review created a bigger dent in Howard’s life than it did in Bratton’s. Potential buyers of Howards’ club turned away and Howard experienced a significant loss of revenue due to Balmen’s review. The defense should present to jurors the possibility that Ryan Howard may have killed Balmen to support their theory that many people had been harmed by Balmen’s reviews and any of them could have killed
