Erik Fresen was a Florida House Representative who served in office for eight years. During his term in office Mr. Fresen didn’t file tax return, owing approximately hundred thousand dollars in back taxes and that is excluding fines and penalties for the crime. In 2011, he received more than two hundred thousand dollars in income tax which he didn’t report that year. Fresen is pleading guilty before Judge Scola because he knowns that he can receive a lower sentence. The prosecutor is asking for one year in prison, and the defense attorneys are asking the Judge for probation. There are two things Judge Scola has to focus, one is whether the punishment for the crime will lose much of its effect because there is a big time gap between the crime and sentence, and second, whether the accuser will learn not to repeat the same behavior again. Crime magnitudes not always goes together with the magnitude of the punishment because many people have gotten away with serious crimes without any punishment, for example in the case of George Zimmerman were he fatally shoot Trayvon Martin in a racial hate act, at the time of the crime many people though he was innocent but as we have seen with his behavior before his death he was not the vigilant civilian many though on the contrary, I believe that he got away with murder. In order to get to the final sentence it is very important that the punishment function as a cues that would help Mr. Fresen to learn from his mistake and to learn to determine which particular behavior is appropriate or not. The discriminating stimulus of the social setting would also provide a stimulus to not repeat the same behavior, especially for someone who is a public figure. The last and most important aspect of this type of sentence and the goal of the Judge is for the accuser to learn from his mistakes. It is very important that the accuser understand and appreciate the punishment. It is very important that he do not receive a reward after the punishment because if not then he is not going to learn from his behavior and the behavior will repeat again (Williams & McShane, 2013). On the contrary, Mr. Fresen has to receive a punishment in additional to the sentence, this would be the only way that he would learn to avoid that kind of behavior (Williams & McShane, 2013) and it would also send a message to other individuals that are committing the same crime.
