The theorist Hershey failed at explaining why people don’t commit a crime by using males without counting females. The earlier explanation for this was that women were biologically nice. Although those who did not fall into this biologically nice group were perversions or physiologically inept. The socialist W.I. Thomas saw men and women as psychologically different. His form of explanation was that women had emotional nerve cells. He claimed that if women if women’s love sensors ran low from lack of attention or love, they would look elsewhere for love. Two major concepts reviewed was that of female victimization and the response of the criminal justice system as well as men violence against women and the link to patriarchal power. (Daly, K, Et. Al,1988) It was because of the lack of women in the criminological study and the slow increase in women studying criminology that the concept of men’s violence against women was not greatly understood. (Daly, K, Et. Al,1988) There are five major themes when referencing sexual violence by men against women. These are; Rape and violence are prevalent, Victims of rape are not taken seriously (especially with abuse in a relationship of intimate couples), rape and intimate violence has been portrayed with myths filled in by works of criminologists, Feelings of wrong or write differs between genders, Strategies for change have been implemented. (Daly, K, Et. Al,1988) It is daunting that rape and intimate violence are the result of a patriarchal system in which the female body and mind are in the control of men. They asked questions like did you scream for help, did you fight back? It was because of the victim blaming and the history of Sara that the DA did not want her on the stand. (Kaplan, Et. The Defense Attorneys and the public believe she asked for it by following them to the game room and getting to high and drunk to function. It wasn’t by any means in the eyes of these people the fault of the men. Even one of the Defense Attorney’s argued that one of the rapist was young and had a full life before him. (Kaplan, Et. Al, 1988) Although this does not constitute violently sexually assaulting a woman. It was for this reason that DA took the deal to begin with. She later regretted her decision because it doesn’t recognize the actions of the people who committed the crime. Sara also held a lot of regret but more of it was anger towards the Criminal Justice system. (Kaplan, Et. Al, 1988) Throughout the movie she felt as if she had been wronged.
