People have the tendency to take the First Amendment for granted, but some tend to use it to their favor. Stanley Fish presents his main argument about how people misuse this amendment for all their conflicts involving from racial issues to current political affairs in his article, Free-Speech Follies. His article involves those who misinterpret the First Amendment as their own works or constantly use it as an excuse to express their attitudes and desires about a certain subject matter. He expresses his personal opinions against those who consistently use the First Amendment as a weapon to defend themselves from harm of criticism.
Lukianoff and Haidt provide examples of how students are trying to eliminate speech that may be found offensive or discomforting on campus in their article for The Atlantic. Two fairly recent terms to understanding this development in student ideology are “microaggression” and “trigger warning.” A microaggression is inadvertently insulting someone or a group of people with something that was not meant to be offensive. A trigger warning is a warning often provided to students when the subject matter of a class may be found offensive or elicit a strong emotional response. These two terms represent the change in ideology towards speech on campuses.
In Derek Bok’s, Protecting Freedom of Expression On The Campus, he brings light to the issue of censorship in universities. He states that students at Harvard University got offended after a few students displayed the confederate flag. There have been many cases in which people have tried to censor offensive material however; the Supreme Court preferred to conserve the freedom of expression. He believes that if censorship starts to take place, it will be difficult to know when to cross the line. In addition, it will not fix the initial problem since the offenders will continue to abuse others using different means.

The amendment tells that all persons born or naturalized in the United States are citizens of the United States (厚). Because the terms “citizens” and “person” appear in this amendment, African Americans certainly have political rights and privileges or immunities (厚). Also, civil rights rooted in the Fourteenth Amendment pointed out that African American can guarantee of equal protection under the law (厚). However, in spite of they are citizens, the discriminatory acts of private citizens and segregation alone were not illegal. The “separate but equal” led to the Jim Crow laws, which resulted in blacks being treated as second-class-citizens.
The 14th amendment is split into five sections. Section one is the most important of them all and it states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” (The Constitution 2014). However it was put to test in the south early on.

If someone is going to have a conversation with another person, than their freedom of speech should be protected, however; if someone had the sole intentions of causing harm or discomfort to the person that they were speaking with or at, then their freedom of speech may not be so protected. Why is it wrong to segregate black people from white people? After the civil war and slavery had been banned for many years at this time, the Southern Legislatures still felt as if they still needed to do something about the African American people. They passed laws known as the black codes which limited blacks’ rights and segregated them from whites. As a result, segregation is wrong because it restricted the rights of African Americans and denied many of a good education.
Since 1969, during the Supreme Court’s decision in Tinker vs. Des Moines trial, ruling has generally been in favor for the student’s freedom of speech. The first amendment is arguably one of the most important amendments and may upset those who feel as if their rights are being violated. However, it is also important to treat others fairly, regarding their beliefs and feelings. Tolerating others is key. This includes respecting their boundaries, ensuring that they feel as if they are in a safe environment.
In Nat Hentoff essay, “Should This Student Have Been Expelled?” he debates that freedom of speech should be valued no matter how it is taken by others. The one example that pops out to me is the student at Brown University, Dough Hann. He states many offensive things about several people and is expelled because it was not the first time something like this has happened. Freedom of speech is difficult subject that has many different views on it.
The idea of free speech on college campuses and the complications of it stem from those on campuses expressing views that don’t align with popular views. Implications for students who use the idea of free speech as a method for hateful actions and comments should be reprimanded, but the question remains as to whether schools should enforce tougher limitations. The freedom of speech on college campus expands to the freedoms of religion, assembly, press, and protest as well. Freedom of expression allows students to show their own political, social, and cultural views. Removing freedoms of speech and expression have consequences deeper than surface issues.
As human beings, we are all born with an entitlement of freedom of speech or synonymously known as freedom of expression as it is a basic human right. It is stated in the Federal Constitution and it is important for us human beings to protect our rights to freedom of speech and expression as it is the backbone for a democratic society. Having the right to express oneself freely without any restrictions is an essential part of what it means to be a free human being. Article 10 in the Federal Constitution states that; (a) every citizen has the right to freedom of speech and expression; (b) all citizens have the right to assemble peaceably and without arms; (c) all citizens have the right to form associations.
