Surrogacy is a modern technique of bringing a child to life. This modern technology was developed in the recent years. Surrogacy is an arrangement that is done to have a baby brought to life when his mother cannot become pregnant because of various reasons, as a consequence a woman that is able to carry a baby will do so for a profit. Different countries have a different view on the legality of surrogacy and likewise have different asking prices for this arrangement. As one of the potential outcomes, the surrogate mother has got attached to the baby emotionally during the nine months of pregnancy, as a result of this she decides to flee to a different state, unfortunately the plan to flee has failed. The surrogate mother signed the contract, which stated that she does not have the right to visit the child, this was seen for the judge as the only option, however this decision is seen as debatable. When living with a person for nine months it creates an unbreakable bond, the bond created by the surrogate mother and “her child” is unlike any contract. As it was said in the case of Mary Beth Whitehead, emotions towards the baby cannot change the legal parents of the baby because of the contract she has signed voluntarily. Eventhough it does not seem humanly to take a child from her mother, it has to be done because of legal issues. The judge does not take into account that Mary Whitehead is in fact expressing personal freedom. The outcome of the case of Mary Whitehead has depended on the view of the judge who was either libertarian or authoritarian, and based on his very own perspective, the case could have even resolved for the benefit of Mary Whitehead. There are several different views and statements that are made up of personal beliefs of one individual, when viewing the case most votes would be for upholding the contract between Mary Beth and the Stern Family.
