There are many issues of concern regarding the legal and ethical aspects of telemedicine. These include the responsibilities and potential liabilities of the health professional, the duty to maintain the confidentiality and privacy of patient records, and the jurisdictional problems associated with cross border consultations. There is also the issue of reimbursement for care provided using a telemedicine service. There is no doubt that unforeseen medical and legal issues could arise from increased but inefficient or ineffective use of telemedicine thus I have the duty to maintain confidentiality and privacy of patients records. I should maintain patient’s privacy during telehealth consultations as much as possible, although it is understandable that privacy might be limited when such technology is used. It will not be out of place for me to ask my patients if they have any questions that might require more privacy than provided. It has several advantages such as being cost saving and providing better access to health care in the remote areas in many parts of the world. However, it has some disadvantages as well. One of the major problems is the problem of patient’s rights and confidentiality in the use of telemedicine (Yadav and Lin, 2011). There are no standard guidelines and procedures in the practice of telemedicine as yet. Birth patient and the physician are unsure of the standard of practice and how to maintain confidentiality. The patient is uncertain as to how to protect her/his rights in the use of telemedicine the issue of litigation is also unclear as to where the physician is practicing when he/she uses telemedicine. Is she the practicing in the country where the patient is or is the physician practicing in the country of her/his origin?. These issues need to be addressed urgently so that telemedicine will have standards of ethical practice and patient’s right and confidentiality will be protected.
