The U.S. Department of Housing and Urban Development (HUD) has issued direction expressing that victimization transgender leaseholders or homebuyers in view of sexual orientation character or sex generalizations constitutes sex segregation and is precluded under the Fair Housing Act (FHA). Although this policy has been established many transgender individuals are still discriminated against, targeted and
Due to the fact of not being read his rights the Fifth and Sixth Amendment was created. Since the Miranda V. Arizona case has been adopted the way U.S. government has helped mold the nation’s justice system by introducing the Fifth and Sixth Amendment. In March of 1963 in Phoenix, Arizona, a resident by the name of Ernesto Miranda sexually assaulted, kidnapped, and robbed an eighteen year old woman as she was on her way home from her usual bus stop. Just days after the incident, the victim reported the events which unfolded that night to the Phoenix police department.
The 5th Amendment to the United States Constitution protects the people from the government who may attempt to force a self-incriminating confession for a capital, or otherwise infamous crime. The only time that pleading the fifth is not possible is during presentment or indictment of a Grand Jury that discusses cases arising in the Militia or public danger. What this means in layman terms is that one has the right to remain silent and not have to take the stand during his or her trial. The issue in the article pertains to the reason as to why the national missing-children’s movement was sparked. It all began back in 1979 when young Etan Patz disappeared on his way to school.
Two hundred and two years, seven months, and twelve days is what it took our twenty-seventh amendment to be ratified onto our constitution. Was this a very sensitive and complex amendment that needed meticulous studying and logistics planing? No, the twenty-seventh amendment simply states that no Senators or Representatives can alter their pay during their tenure and only can it be changed when their term is up. In the constitution it states "No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of Representatives shall have intervened". While this seems so simple, there seems to be some inherent complexity to it.
The Twenty-fifth Amendment of the United States Constitution revolves around succession to the Presidency and construct procedures for filling a vacancy in the Vice President’s office, as well as responding to Presidential disabilities. It also supersedes the arguable terminology of Article II, Section 1, Clause 6 of the Constitution, which does not clearly state whether the Vice President becomes the President, or Acting President, if the President dies, resigns, is impeached, or is otherwise unable to honor the powers of the presidency. The Twenty-fifth Amendment is broken down into four sections, all pertaining to the Presidency, and what should happen if anything goes wrong. In regards to the Vice president becoming president, the only

This law is regulating workplace discrimination, use of public accommodations, minimum wage standards and the right to sue. The law known as HB2 makes it illegal for cities to expand upon state laws, as more than a dozen cities had done, including Charlotte, Raleigh, Chapel Hill and Durham. Transgender people who have not taken surgical and legal steps to change the gender noted on their birth certificates have no legal right under state law to use public restrooms of the gender with which they identify. Cities and counties no longer can establish a different standard.
The Fourth Amendment contains some points that could be used for malicious purposes and technically still be Constitutional. For example, law enforcement officer can use a subpoena instead of a warrant, according to Your Digital Trail: Does the Fourth Amendment Protect Us? (2) Subpoenas are easier to get since they do not require a judge to determine if there is probable cause, yet there are more ways a law enforcement officer could cheat to get someone to remove his/her rights. According to Wex Legal Dictionary | The Fourth Amendment, if the person convicted confesses or agrees to nullify the effects of the Fourth Amendment, it cannot protect them.
This landmark case affirmed that the 6th Amendment applies to all states under the 14th Amendment. Not only did the video show the importance of the amendments to the constitution, it also demonstrated the possible pitfalls of judicial review, but also its ability to ensure the personal rights provided by the constitution are not
Even Donald Trump has said the laws being passed are ridiculous and will cause more problems than they seek to solve. This is already being shown to be true, as people who appear to be men have been led out of the women’s restrooms by police, only to discover they are in fact anatomical women. This is a waste of taxpayer money, and a waste of resources (Steinmetz, 2015). What if an actual crime had taken place in the time it took to sexually harass a female for trying to use the bathroom, how would that news story read? There is no actual evidence that transgendered people pose any kind of threat to anyone else using the bathroom, most transgendered people are heterosexual, meaning that a transgendered woman is attracted to men, and vice versa with transgendered men.
However, Forcing people to go to a bathroom that is specified for a gender identity that does not match their own, is absolutely a violation of civil rights, this is even worse than the straight people’s violation of rights. Transgenders shouldn't be restrained to use the bathroom based on their birth assigned gender. Here in the U.S. we have a lot of freedom, people have been fighting for their equal rights since a long time ago, no body should be looked at differently after all we are all humans; “The proposed Equal Rights Amendment (ERA) states that the rights guaranteed by the Constitution apply equally to all persons regardless of their sex”(http://www.equalrightsamendment.org/). Transgenders are humans just like anyone else,in the world. The world would not stop spinning they choose to use whatever restroom they want, with this step discrimination can become less common in the
Most recent of those laws include the Mississippi Religious Liberty Accommodation Act, which intent is to create a discrimination friendly environment for gender and sexual minorities. For instance, LGBT people might be denied service, employment, housing, etc., based on the religious belief of the person offering those benefits. In the same vein, the State of North Carolina House dominated by Republicans passed a bill forcing transgender people to use the restroom of the sex listed in their birth
There are incidents that have happened in the past involving the laws that help people that despise transgender people. As there are more incidents of violence occurring, it
The term “transgender” is a label that was never used until the mid 1960s. According to history, “Psychiatrist John F. Oliven of Columbia University coined the term transgender in his 1965 reference work Sexual Hygiene and Pathology (“Transgender”)”. When a transgender person desires to be the opposite gender, they may get an invasive surgery to fully transition into their new identity. Multiple transgender people have started to announce the having of the surgery has destroyed their future (Bindel). People have the right to be whatever gender they aspire to be, but transgender people should do public activities and should stay grouped with their biologically assigned sex.
Many people now think that a transgender restroom should be a common concept, and that it should be OK if a grown gentleman follows a little girl to the restroom. Transgenders only make up .3% of America 's population. I know this due to the fact that I have done extensive research on the topic of transgender restroom and, I believe that once you hear what I have to say I will have altered your mind for the better. I want you to feel concerned for the safety of the public, and informed on why transgender
