Dustin Moir was subjected to a Mr. Big operation following the discovery of a young girl’s remains in 2006. Due to his confession during the investigation, he was convicted of first degree murder in 2010 following a jury trial. This case reflects the appeal of his charges with considerations to admissions during the subsequent covert investigation against him.
Review of the facts
In 2005 fourteen year old Chelsey Acorn left her foster home without permission and was last seen in Abbotsford. Moir willingly complied. He claimed that all three of them drove to the isolated campsite area, where Acorn would subsequently be buried and during this drive they both had sex with her. Additionally, Moir stated that he set up a tent and dug a grave and proceeded to bound Acorn. Both his father and himself choked Acorn to death and then put her in the grave where they covered her in rocks. Dudley’s statements contained inconsistencies. Further, it led to the belief that Dudley was simply trying to exonerate himself as a witness when giving his statement against Moir. In addition to Dudley, another key witness Mr. Gordon’s statements also had inconsistencies. Gordon claimed that he had given a shovel to Moir prior to Acorn’s death. This may lead the jury to believe that Moir’s involvement in Acorn’s murder was planned and deliberate (para. 27). It was later found that there was no direct evidence of this exchange between Gordon and Moir. Rather this exchange of the shovel occurred between Gordan and Mr.
