15. The Case of Keith Mondello (New York, 1989) On August 22nd, 1989, Mondello had a run in with Gina Feliciano, the two had a feud. Mondello did not like that blacks that Feliciano hung out with. He told her that the blacks would get hurt if they came to Bensonhurst. She told Mondello that the blacks would come fight. The next day August 23rd, 1989, Mondello gathers his friends and a few from 18th Avenue, including Joey Fama. Fama told people he is carrying but Mondello was not around. Hawkins, Sylvester, Stanford, and Banner rode the wrong train, and ended up in Bensonhurst. Mondello and the group he the blacks thinking it is the people Feliciano described. Fama pulled a chrome-plated .32 caliber semi-automatic pistol from his waistband. Someone told Fama not to shoot, but he fired four shots at Hawkins, one hit his hand and the two shots strike Hawkins in the chest passes through his lungs and heart. Attempted murder is a class A felony. He committed the crime almost killing Wendy and hurt multiple other people. He is responsible for the act that he committed, he slammed Wendy down in the pavement and punched her, no one else is responsible but Weaver. Indiana, 270 Ind. 618, 388 N.E.2d 507 (1979), it says the defendant is found guilty of attempted murder where he severely beat a woman using a deadly weapon and continued the attack even after she lost consciousness and fell down.
