There is also an inclination to believe that if he had not suffered from this state, then the offence would not have been committed, specially not in the barbaric way it was done. Thus, it cannot be concluded that the accused willfully preformed the act, nor that the mens rea and the actus reus coincided while he was not in a psychotic state. (Roach, 113) Related to this finding is another element that supports the verdict of the Honorable Judge, which is the Principle of Fundamental Justice that states that no one should be “punished for morally involuntary actions.” (Roach, 82) A person who successfully raises the mental disorder defence is considered to be morally innocent of the act because they were not acting freely, in this case, free from psychotic ideations.
There has been many law changes for determining insanity in the legal setting. The first major law change was the case of Andrea Yates who pleaded insanity after killing her five kids. Ms Yate suffered from postpartum mental illness, which at that time qualified for insanity. Her case was extremely conversional because many people believe that she knew the differences from right and wrong. Therefore, resulting into an outrage of people and a change in the law for insanity.
Ladies and gentlemen of the jury, you are here because one person in this courtroom decided to take law into her own hands. The defendant, Mrs. Dominique Stephens, murdered the man that she vowed to love. This sole act by the defendant is violation of all morals and her husband’s right to live. Afterwards, she even felt guilty about this violation of justice and called the cops on herself, and she later signed a written statement stating that she is guilty of the murder of Mr. Donovan Stephens. Then the defendant later recanted this statement and said that she only killed Mr. Stephens in self defense.
Theory of Holmes’ Case My theory of this case is to believe this case wasn’t a case of insanity because this individual clearly planned his actions. Holmes stepped out of the movie theater and returned wearing protective gear. His outfit was described wearing a “ballistic helmet, protective gear for his legs, throat and groin, black gloves and a gas mask. He props open the door, before throwing two tear gas canisters into the theater” (“Colorado Theater”, 2017).
Ana never thought about the backstory to what had happened. Ana was upset because they promised not to leave each other and once Maya left her for a boy Ana's emotions got the best of her. Ana stormed out of the party and walked home alone in the dark out of anger of being alone at the party. A week after Maya got raped she had the courage to speak out to her parents and the police, she got put into a hospital for testing and to make sure she's ok and that she gets the help and support she needs. While in the hospital Ana would visit everyday to comfort and be there for her best friend.
Justice Tindall, whom was present at the M’Naughten trial when the insanity plea became a legal defense, breaks these rules into 3 statements. “Every person is presumed sane unless the contrary can be proven otherwise” (Allnut, et al. 293), which in this case it cannot. “A person suffering a ‘partial delusion’ should be dealt with as if the circumstances of the delusion was real” (Allnut, et al. 293). If Minnie was suffering from some sort of delusions, she would have used that as an excuse once Mr. Hale found her or would’ve had some crazy story on what happened. She got straight to the point.
Can you cause insanity by depriving someone of socialization? In the story, “A Rose for Emily,” it seems to hold true. Emily grew up under a controlling father that did not let her associate with the townspeople. Later in life, after her father died, you began to see her insanity creeping out. She denied that her father died for three days until she finally allowed someone to come in to take his body away for a quick funeral.
Instead she chooses to act insanely, seeing the children in the worst possible way when they aren’t actually bad. This shows her insanity because she accepts this fact and still makes certain decisions, and if she wasn’t as paranoid the children wouldn’t fear her. As she is watching the children, she is hoping that her suspicions come true and this shows her insanity since she had been doing this for several days to no avail. These actions prove the insanity is caused, in part, by her unjustified
Throughout human history, humans have been known to execute gruesome acts. Whether these acts are small and insignificant or massive and change history, humans are capable of performing horrific plots against one another. To make matters worse, most of the people who commit these terrible crimes are people who are entirely in a clear state of mind. Nevertheless, there are some cases in which the line between sanity and mental instability blurs. For example, there is an ongoing debate regarding the mental health of the main character in William Faulkner’s story “A Rose for Emily.”
Intro: “It is sometimes an appropriate response to reality to go insane” (PHILIP K. DICK, Valis). In present day America laws have been placed that prevent people who are “insane” to be guilty of the crimes they commit. In short, insanity is the state of being seriously mentally ill relating to madness. This is presented in the book Medea written by Euripides through her point of view. In Medea, a surge of insanity purges her after she is betrayed by her husband Jason causing many cruel and harsh actions to follow from her.
Although, just because they have a mental illness, doesn't mean that's the reason they did their crime. I believe the insanity defense could have been the best outcome for the defendant, because they would have been treated for their mental
Insanity is a disease capable of making a person lose control of themselves. On the other hand, sanity is when a person is what others call “normal”. In “The Tell-Tale Heart” by Edgar Allan Poe the narrator kills a man and he is confessing to the cops about it. He confesses how long the murder took and what he did each night and how he executed the murder. However, the narrator is not guilty because of the reason of insanity.
Insanity is not a valid defense for one main reason. You are either crazy or you are not. In the end, Mack Herring was acquitted for murder. He felt as if he was pressured into doing it and he also thought he was helping her by committing the crime.
“Insanity: n. mental illness of such a severe nature that a person cannot distinguish fantasy from reality, cannot conduct her/his affairs due to psychosis, or is subject to uncontrollable impulsive behavior” (Hill). This definition describes the narrator, a sweet yet deadly man, of “The Tell-Tale Heart” by Edgar Allen Poe seamlessly. (Appositive) A few prominent characteristics demonstrate the narrator’s insanity, and those include his motives, his actions, and his thoughts.
She was emotionally very disturbed and socially withdrawn following the incident. In addition, she was also depressed with insomnia, poor appetite and had significant weight loss. She felt hopeless and worthless but not having suicidal ideation. Her decision for
