For this week, I was assigned to read the chapter, Cravat Coal in Confessions of a Union Buster, were written by Marty Jay Levitt and Terry Conrow and the article was published in 1993. In the article, Levitt and Conrow talked about a lot of things but mostly Wagner Act and what the employers can do or not to the workers. The question for this assignment—“Based on details in the article, “Cravat Coal”, how does the Wagner Act favor the employer?” The authors talked about delaying time showed the workers that union is not a quick fix.
The Knights of Labor was the first major American labor union created around 1871. It was configured by all productive laborers from the factories to fields, whose leader was Terence V. Powderly. Their goals were to adopt a system that could which will secure the labor job and involve the government to protecting the workers. In addition they were fighting to obtain 8 hour work day, graduated income tax, cooperatives.
Frances Perkins, a survivor from the Shirtwaist Factory Fire quotes “Moved by this sense of stricken guilt, we banded ourselves together to find a way by law to prevent this kind of disaster.” Frances Perkins became secretary of Labor under President Franklin D. Roosevelt, and this quote said by Perkins “something must be done. We’ve got to turn this into some kind of victory, some kind of constructive action,” helped new workplace safety standards into law in the state of New York. The benefits that I would like the audience to see is how workplace safety is important by learning about the history of regulation, OSHA, and workers compensation.
The Norris-LaGuardia Act was implemented in 1932 in order to eradicate certain legal and judicial barriers against the actions of organized labor in the United States. The Rift between the trade unions and the employers are not unknown to the world, as this issue has been raising its head every now and then in the history of industrial and labor development. Many acts and legislations have been enacted throughout the past century to bring some kind of a balance between the relation of the unions and the employers of labor. Norris Laguardia Act of 1932 is one such act that was enacted work in favor of the organized labor. The adoption of this act, allowed Congress to liberate the organized labor from the most extreme controlling Federal court injunctions.
Before the structured labor society that we live in today, America was a very different working world; one plagued with injustice and grievances from workers across the job sectors. Two organizations, the Knights of Labor and later the American Federation of Labor acted as activists for reform and demanded better standards for working, living, and life for workers. Their strategies and success in achieving their goals were as different as the organizations themselves. Coming from a time of segregation and social divide, the Knights of Labor stood out as one of the most accepting labor unions of the age, which largely accounted for their membership to reach almost 800,000 members during its peak. All workers in a trade were included, regardless of their skill level.
According to AF McEvoy, the fire was “the most dramatic example of industrial disaster in the annals of American labor history” (McEvoy, 1995). This tragedy sparked outrage among the public and drove a movement to improve workplace safety. As a result, the Factory Investigating Commission was established, which led to the passage of numerous labor laws that aimed to protect the rights of workers. These laws established standards for working hours, wages, and safety measures, and provided workers with the right to organize into unions.
The feeling, shown in Nast's illustration after the railroad strike of 1877, that amalgamations simply lead to more " communistic values" and general uniformity made it very arduous to genuinely get anything done. Samuel Gompers, progenitor of the American Federation of Labor, argued that the right to strike was absolutely obligatory if any reforms were going to be made and not even this right had been officially granted to the people by regime (Document I). Gompers made it very pellucid that not even the very substratum of organized labor had been established and so up until this point the advances that had been made, were virtually frivolous. In conclusion, from 1875-1900 very few advances were made through organized labor in achieving better working conditions for workers.
Sprouting off of the Wagner Act, the National Labor Relations Board (NLRB) was formed. Lastly, the Fair Labor Standards Act instituted nationwide enforced wages and hours for jobs (Britannica). Through the New Deal and its sequels, Americans received aid and employment. At a glance, the New Deal may not seem very disastrous, but inspected slightly closer, its errors are easily grasped.
Have you ever wondered what it would be like without transportation? In the 1890’s the railroad system, the main source of transportation at that time, came to a halt after a strike called the Pullman Strike. A severe depression had hit the United States in 1893. This hit a railroad manufacturing company called the Pullman company hard.
The National Labor Relations Act allows employees to form a union or join a preexisting union. The same act prevents employers from standing in the way of workers attempting to unionize. Many organizations frown on unionization, but regardless of their opinion, they cannot interfere with employment rights. Employers are violating the law if they threaten employee 's jobs, question union activities, or eliminate benefits for employees by unionization. They also cannot offer benefits or perks to employees for refusing to unionize, as this could be seen as illegal persuasion (Employer/Union Rights, n.d.).
The Wagner Act –also known as the National Labor Relations Act- was a New Deal reform that was passed by President Franklin Roosevelt in 1935. It was a great tool in preventing employers from messing with workers’ unions and protests in the private sector. This act made a foundation for the National Labor Relations Board (NLRB) to protect the rights of workers for them to organize, bargain collectively, and strikes. In 1930, millions of workers belonged to labor unions.
*Pullman Strike * The Pullman Strike was widespread by the United States railroad workers, approximately a quarter-million worker were on strike at the peak and it impacted the expedition the railroad system across the states. The strike between the American Railway Union and George Pullman changed the course of future strikes when President Grover Cleveland ordered federal troops to break up the strikers; its influenced how the federal government and the court system would handle labor issues. The Knight of Labor came into existence around the 1880s and consisted of numerous local assemblies. Membership was opened to any and everyone, including employers, African Americans and women. To achieve efficiency, its goal was to replace capitalism by offering the employees, also known as producers, the opportunity to control and own businesses. The system was known as producer cooperative. Producer cooperative incorporates capital and workers to work as one and cut down on conflict, which made for a harmonious environment.
