The ICCPR treaty is also being not working favor of minority students across America. Academic tracking is a fundamental component of the public school system that is not protecting students. Academic tracking is typically based on standardized exams, teacher recommendations, and parental intervention. It is common knowledge that standardized testing is racially biased putting minorities at a disadvantage, furthering expanding the opportunity gap. Test such as the SAT have already been examined and exposed for their heavily racist influences though they are still used as a resource in order to be accepted into college causing whites to be advantaged over many other minorities.
