Miranda Rights: The Pros and Cons of the Miranda Rights Police officers should not be required to read the Miranda Rights under every situations. There may be a situation when timing is critical and the safety of the officer or the public is the main concern. This would be in a scenario where a subject may have a weapon or a terrorist may have a bomb hidden in a backpack. There may be a time in an emergency situation where there is no time to read the Miranda Rights. The main concern for all is to get the weapon out of harm’s way. The officer may need to ask the subject questions, such as where is the bomb, where is the gun. That is where the Public Safety Exception to Miranda Rights comes into play. There are many pros to the Miranda right. A suspect may not know that they have the right to an attorney, even if they cannot afford one. This allows someone who is poor to have the same access to the legal system as someone who is rich. The suspect may not know that they do not have to answer the police officers questions. The officer is trying to put together what had happened and may be anxious to ask questions in trying to establish the facts. The officer may be in pursuit of the subject and a struggle may occur. The officer is focused on restraining the subject and staying alive, as well as keeping everyone around him/her safe. For an officer to have to stop what he/she is doing, and read the suspect the Miranda Rights could be detrimental. The officer may want to know if there is another suspect in the house, or if there is a weapon around. Timing and response can be a matter of life or death. Another con is when a suspect replies yes, they understand his/her rights and are willing to speak with an officer, then he/she has effectively waived his/her rights and may not have realized
