Andrew Madison has been charged with three crimes, disorderly conduct, assault and battery, and assault on a member of a police force. Throughout this report, I will address and express my opinion on each of those violations and whether he is guilty. Andrew Madison is guilty of disorderly conduct. He and his friend, Lincoln, were harassing fellow students, causing a disturbance to the peace. While they claim their actions were merely jokes, their peers appeared offended and hurt. It is also known that Madison has a nasty reputation. He is extremely disruptive in class and other students at CLH fear him. Officer Bates rushed to Madison and arrested him without informing him of what he was being detained for. As Madison was taking out his Student I.D. that was asked for, Bates assumed he was pulling out his knife, which Madison claims is only used for cutting fruit, and attacked him. Madison's claim of acting out in self-defense is supported by the fact that Bates pounced on him without any clear justification. Bates had no reason to be so aggressive with Madison and shouldn’t have immediately resorted to violence. Bates has also had reports of being overly aggressive with other people. His threatening approach to Madison and others in the past raises questions about whether the way he handles situations is appropriate and the legitimacy of Madison's charge for assault and battery. Andrew Madison is not guilty of assaulting an officer. Again, he only shielded himself from Bates's harsh and irresponsible behavior and his actions should not be considered an act of assault. Madison was likely concerned for his safety and was attempting to protect himself from Bates rather than deliberately assault him. Lincoln stated he could even hear Madison screaming out for
