* * * I feel that it would be impossible to ensure that there were the safeguards in place to protect society from your possible actions.” (victim parent, 2002). As empathetic starts, citizens will side with the victims of the defendant’s crimes because they belief the defendant’s crimes were out of evil and cruel torture and deserves all the punishment he can get and not get a break and let back to society where he has the ability to commit potential
In the case of Tara Brown’s murder, various groups of individuals are affected. As well as maintaining principles of fair punishment and deterrence, the criminal justice system has to consider perceptions of the victim’s family (secondary victim), the community’s demand for crime prevention, and the offender’s rights to a fair court hearing. The most likely outcome is imprisonment for Lionel John Patea due to committing an indictable offence. It is important to note that if this was only a case of domestic abuse without murder, it would utilise more time, effort and expenses to come to a resolution. This is due to the different circumstances and degree of abuse that the judge has to assess.
Sentencing the Victim Throughout Sentencing the Victim, Joanna Katz was victimized more than once. During Joanna Katz process with the criminal justice system, she showed courage and strength. According to Joanna’s father, “When sentencing the offender, the victim gets sentenced too because as long as they are locked up, we are sharing that sentence with them.” On numerous occasions Joanna gets victimized from the actual criminal acts, to going to court every year for each offender.
Mr. Coker tied the male subject up and then proceeded to rape the male subject’s wife. Mr. Coker had taken the keys to the family car and proceeded to leave
Throughout the entire course of the case, this problem was seen through the prosecutor’s use of cultural stereotypes, using biased and uncredited witnesses and poorly conducted court and investigation processes. During the trial, the prosecutors used many religious stereotypes to create a case argument. These points made were not validated, creating preconceptions, showing their views towards Adnan and his religion. Moreover, when the witnesses were interviewed by the police or prosecutor, they used the witnesses words which were not validated nor supported to paint a picture on the suspect, Adnan. Also, the improper use of the court and investigation proved to be untrustworthy.
There are many famous phrases out in the world, but the one that people tend to use the most is “An eye for an eye”. Mary Shelley’s Frankenstein, analyzes the role of punishment and forgiveness in society. This novel makes the people apply the lessons of writing to our own particular moral convictions with respect to the part of punishment and forgiveness in the justice system. Through the actions of Victor Frankenstein's creature, and their society, the novel explores the complexity of ethically and legally attaining justice and its circumstances. The monster does not say that he is justified in killing Victor’s loved ones, but his categorizing his murders as some type of getting Victor back in some way.
We are here today to discuss a very strange case, a wife turning her back on her husband, but she shouldn't be punished. Although Montag broke the rules, he was her husband and she should have protected him. Mildred thought what she has been doing, was the right thing because she has been going through a rough patch with depression, she didn't know any better and she was protecting herself. Therefore, Mildred should be justified in turning in Montag. She is simply a victim of society.
The first rule that is presupposed by the action of Officer Jankowski charging Samantha with a DUI can be formulated as; Officers should enforce the law no matter who the accused is. The alternative rule that can be presupposed by Officer Jankowski’s action of letting Samantha off with a warning would be formulated as; Officers should take into consideration who the accused is when enforcing the law. Now, it must be determined who the proper audience for the rule is. All people would be effected by this rule, specifically people who are prone to committing illegal acts. In this case Samantha, her family, Officer Jankowski, the police department, and other citizens driving on the same road as Samantha would be effected by the rules.
My reaction to code of Hammurabi is that it is wrong to have this mentality for some types of crimes. For instance it would be wrong to chop the hand off of a thief because what he/she is taking can be brought back or replaced. Sometimes the thief will steal for basic things like food. This eye for an eye can be used for certain murder cases. For example if a person kills another person just for the benefit of that individual.
Moral Ambiguity and History within The Assault Harry Mulisch’s The Assault is a self-proclaimed “story of an incident” (3) wherein “the rest [of the events are] a postscript” (55). The incident in question is the murder of Anton Steenwijk’s parents, and the postscript refers to the future, where Anton uncovers details relating to the incident. Despite Mulisch’s definitive distinction between events, however, the incident itself is convoluted and its details shift over the span of the work. Through the development of major and supporting characters, Mulisch brings forth a diverse range of perspectives and reconstructs the history of the incident, thereby exploring the motif of moral ambiguity within The Assault.
Serial homicide is among the less common, but most heinous crimes an individual can commit. The vicious act of murder is unfathomable to most human beings, but research is not lacking in the attempt to provide an explanation. Criminological research is notorious for integrating theoretical perspectives to create an overarching explanation for different crimes. This paper will attempt to provide some insight to the crime of serial homicide. The difference between homicide and murder as outlined in the Criminal Code will be presented.
Advertising is a form of marketing that is used to promote and sell something, but many times it manipulates us into buying things that we normally would not purchase. The focus of this paper is to bring attention to the deception that is used in advertisement. Under Clause 1 of The Canadian Code of Advertising Standards is Accuracy and Clarity.
The third code is family law. In law 195 it says, “If a son has struck his father, his hands shall be cut off.” The son should be punished however, cutting off his hands is very extreme. There is no age listed in this law and what if it was a child? In law 129 it also shows that the laws were unjust.
Sexual assault laws have been amended and created over time to ensure the criminal justice system remains sensitive to the tribulations involved in rape trials for the victim. However, the connotative capacity of language used in evidentiary testimonies in rape trials can defeat the purpose of these reforms as ‘language is not merely a means of putting forth evidence in a case, but it in fact transforms the nature of evidence itself, thus influencing the outcome of the case’ (Maheshwari 2014:1). As theorised by Bourdieu (1982) symbolic power as ‘the power to create reality through language’ (Matoesian 1995:38) is successfully employed in rape trials to instil patriarchal and legal domination over the victim. The use of language in courtroom
Mendelsohn calls the victim and his offender the ‘Penal couple '. The victim offender relationship may contain origin of victimization. The inhibitions and offender may have seemed to change according to the type of qualities the victim possesses. The attitude and behaviour of the victim influences the offender and which makes possible the criminal act.
