Uber has been very instrumental in many communities for people who don’t have a personal ride of their own and are dependent on public transportation or other to get them to their destination. Ridesharing which in a onetime shared ride with limited notice, helps in the transport infrastructure in any city. Over the years Uber has been a very successful business that operates in many countries. To decide if Uber might be liable for the conduct of its drivers depends on the situation at hand and the driver’s behavior. Dealing with hiring negligence, wrongful death or causing emotional distress are circumstances that Uber would possibly be responsible for. For a driver to be considered negligent, it means the driver did not perform a duty of reasonable care to other drivers on the road or their passengers. For any sexual attack that may occur in an Uber vehicle, or involving an Uber driver, the company may be held accountable for the incident. Even though the Uber drivers are independent contractor, Uber acts a lot like an employer because it vets its drivers, dictates their appearance and behavior and takes a percentage of each ride. For many years cab companies who have employed independent contractors have faced negligent hiring charges and Uber is no different (Hower, 2014). Uber may be liable for the conduct of its drivers under the guidelines of the action of the agent who is within the range or scope of apparent authority.
