Assignment 5A subpoena is a written order issued by a court clerk or an attorney to compel a person to attend and testify at a particular hearing. In some cases, it is required to bring or send certain documents. Whenever healthcare providers are responding to subpoenas regarding medical information, it is very important that they respond immediately. They would need to follow certain steps or protocols.First and foremost, there needs to be confirmation of its validity. Making sure it is from a legal entity. They would need to verify what documents are needed and that the parties involved are aware of the subpoena. In other words, verify what documents make up the legal health record. One important step is to make sure that the HIPAA privacy rules which govern healthcare are adhered to and that in responding to the subpoena is abiding by rules and protecting patients’ privacy.In order not to have different responses the director should make sure these legal health records are accurate and up to date, if any new or updated information in the records should be inputted as soon as possible and tracked by date and time, including late entries. They should be put together in one place which means deciding whether paper/electronic documents are going to be used, and limiting certain access to these records, that is who can access them. This means having a system in place to have the necessary information that will be needed and not to cause any confusion or miscommunication. They then would verify if this was the first time a subpoena had been received and if there was any response that had been sent back out. Also, verify along with the response if any documents
