Yes, you can apply for an “intervention order” against Tom to prevent him from having contact with you and the children. Intervention Orders The law recognises the detrimental effect that family violence has on adults and children, as a result, in Victoria through “Intervention Orders”, the court aims to maximise the safety of anyone who is affected or exposed to any form of violence by prohibiting particular acts or conduct of the alleged offender against the alleged victims. You can apply for an intervention order at your local magistrates court, this is a relatively simple process without any previous requirements. Moreover, intervention orders can be granted urgently when the court is satisfied that the safety of the applicants is
She discussed the Battered Woman Syndrome and examined its application to ten women's defences in their murder trial; she highlighted its strength and its weaknesses. She dispels different myths surrounding battered women, like why they remain in the relationships, why they do not report the abuse, discounts physical attacks as the only form of abuse and how the imminence of the attacks are not necessary for killing their partner. Sheehy hopes to draw attention to the ways battered women are unfairly treated by the legal system. They have distinct experiences that separate them from the typical murderer, and these experiences require special attention. She wants to change the public opinions which contribute to the further victimization of battered women and enable these women to receive the necessary assistance they need from the courts and other social
PA 604: Domestic Violence Data Exploration Project My research topic for this data exploration project was influenced by reading the Bureau of Justice Statistics 2014 Annual Criminal Victimization Report. From that publication, an intriguing statistic caught my attention and research interest. “The rate of domestic violence, which includes crime committed by intimate partners and family members, remained stable from 2013 to 2014 (4.2 per 1,000). No measurable change was detected from 2013 to 2014 in the rate of intimate partner violence (2.4 per 1,000), which includes victimizations committed by current or former spouses, boyfriends, or girlfriends” (BJS Criminal Victimization, August 2015). I decided to investigate how this statistic was concluded by the Bureau of Justice Statistics (BJS).
Changes have to be made for the future, police that is handling cases such as intimate violence should have a prompt response. The restraining order wouldn’t do any good if it isn’t enforced, the perpetrator should be return to police custody to guarantee the safety of the victim. Compensation can be used as a tool to discourage offenders from committing acts. Families and victims should be compensated for the grief that they were put through and the losses they may have had (Fattah & Peters,
According to the Ontario Policing Standard Manual, the mandatory charge policy procedures should provide that in all domestic violence occurrences an officer is to lay a charge where there are reasonable grounds to do so (Johnson, 1996). The policy emphasizes that a decision to lay charges should not be influenced by the factors such as marital status/cohabitation of the parties, previous records, unwillingness to cooperate, and the concern about reprisal against the victim by the suspect (MacLeod, 1995). Some of the assumptions of the mandatory charge provide that the arrest of abusers in all cases, irrespective of victim preferences and knowledge is considered to be essential for safety, and charging is seen as essential to enforcing
Under the Minnesota Domestic Abuse Act, which states, to issue an order for protection one must be reasonably in “fear of imminent physical harm”, will the court consider whether Alexander Abington’s verbal threats, physical actions, and frequent texts direct messages and emails, sufficient to cause Rachel Wilson’s reasonable fear of imminent physical harm? Brief Answer Alexander Abington’s verbal threats, physical actions, and frequent texts direct messages and emails will be sufficient to establish that Rachel Wilson was in reasonable “fear of imminent physical harm” and therefore, Rachel Wilson will be granted the order of protection. Statement of Facts Rachel Wilson and Alexander Abington are residents of Anoka, Minnesota. In 2014, Rachel Wilson began a romantic relationship with Abington.
Introduction Domestic violence is a pervasive and complex social problem that has an enormously detrimental impact on individuals, primarily women and children, throughout the entirety of Australia. The Labor Party has focused on this issue in chapter 9 of their national platform (Australian Labor Party, 2015). Recognizing the gross violation of gender equality that domestic violence represents, the Labor Party states that it’s eradication “must be a national priority”. The primary solution recommended by the Labor party is an integrated response that advocates change on a local, state and national level. The party plans to prioritize full implementation of the National Plan to Reduce Violence against Women and their Children 2010-2022, a
This can help to prevent further violence by removing the abuser from the situation and sending a clear message that domestic violence will not be
I believe that the SDA official statement plays an important role in pursuing the fight against domestic violence and brings out some key ideas that helps illuminate the issue. Not only does the concepts in the statement provide some valid points it helps with realistic solutions to the problem. Domestic violence is serious with some 4000 woman dying each year as a result , bearing in mind that while only a number it is real woman , mothers and wives to real families. Having researched from a wide range of resources i have found that domestic violence is not simply just an act but an attitude as well as a cycle that many find hard to break of. The cycle of the abuser influencing the abused to replace them , making this problem not only go unnoticed but growing.
Slide 12 - Main policies surrounding domestic violence – Domestic violence, crime and Victims act 2004 – This is the biggest law which is put in place to attempt to put a stop of domestic violence (Home office, 2005). Its main aims are to: • Make anyone over the age of 16 liable if there is a child death. Under this act, it states that anyone over this age can be charged with the offence of causing or allowing the death of the child if they live in the same household at the time of the incident (Matczak et al, 2011). • Protect any victims or witnesses of domestic violence.
However under this law there is no duty to retreat, and a victim retains the right to ‘stand their ground’. This law is believed to deter violent crime and empower victims of assault and robbery.
Social work practitioners are involved and aware of all social justice issues in the world today. Domestic Violence is just one major social justice issue which has become more prominent in the world. According to Royal College of Nursing (2013), domestic violence is an incident involving controlling and violent behaviour between intimate partners and/or family members. It also involves physical and emotional abuse. A practitioner working in the field of domestic violence can apply different theories in order to present the best possible outcome for the service user.
Domestic Violence is often defined as the recurring pattern of behaviour in an intimate relationship that is used in order to control, maintain or gain power over a partner; this includes physical, sexual, emotional and psychological abuse (Davies 2008, p. 1; Department of social services 2015 & Australian Bureau of statistics 2013). The principal purpose of this essay is to offer a range of sociological explanation that justifies why domestic violence is happening. Social conflict and symbolic interactionism are the two theories that have been explored. The paper argues that micro level analysis offers a deeper understanding of the motivation behind domestic violence, compared to a macro level one. The study also contains recommendations that
I strongly believe that there should be tougher law enforcement to protect against domestic violence. No one should experience or be exposed to domestic violence for it; affects family life’ increase the crime rate in countries, and it affects one’s body and mind. Firstly, domestic violence causes a number of effects on family life, it affects how family members relate to one another because they will not feel the appropriate
